EASEMENT AGREEMENT <br />201303238 <br />THIS EASEMENT AGREEMENT ( "Agreement ") is made and entered into as of <br />p ,-,1 I $ , 2013, by and between Jay Bockmann and Eric Bockmann, Grand Island, <br />Nebraska ( "Bockmanns "), and Karen S. Autrey, Successor Trustee of the Maynard A. Boltz <br />Trust ( "Trustee "), and is made with reference to the following: <br />A. The Bockmanns own certain real property located in Grand Island, County of <br />Hall, State of Nebraska, more particularly described as "Parcel 1" on Exhibit A attached hereto <br />and incorporated herein by this reference and operate the same for agricultural uses. The <br />Bockmanns have this date purchased Parcel 1 from the Trustee. <br />B. The Trustee owns certain real property located in Grand Island, County of Hall, <br />State of Nebraska, more particularly described as "Parcel 3" on Exhibit A attached hereto and <br />incorporated herein by this reference and operates the same for agricultural uses. <br />C. In order for the Trustee, her successors and assigns, to access Parcel 3, it will be <br />necessary to cross Parcel 1 from the point at which the north -south public road right of way <br />(Blaine Street) making up the west boundary of Parcel 1 shown on Exhibit A turns west to the <br />property line of Parcel 1 and Parcel 3, a distance of approximately 90 feet. <br />D. Parcel 1 and Parcel 3 are adjoining tracts. The Trustee desires to acquire a <br />permanent easement for right of ingress and egress over a portion of Parcel 1 to enter and exit to <br />and from Parcel 3 to the public right of way on Blaine Street. <br />NOW, THEREFORE, FOR VALUABLE CONSIDERATION, the receipt and <br />sufficiency of which are hereby acknowledged, the parties agree as follows: <br />1. Grant of Easement. The Bockmanns grant to Trustee an exclusive easement over Parcel 1 <br />for ingress and egress to and from Parcel 3 to the public right of way on Blaine Street. <br />The Easement Area ( "Easement Area ") is shown on Exhibit B attached hereto and <br />incorporated herein by reference. <br />2. Scope of Easement. The easement granted herein shall constitute an access easement and <br />for the full and free use of the easement area for the purpose herein described. The <br />easement is for the use of the Trustee and her successors and assigns, tenants, visitors, <br />licensees and permittees. The easement is exclusive to Parcel 3. The Easement Area <br />shall not be used except for ingress and egress to and from Parcel 3 to the public right of <br />way on Blaine Street. Except as provided herein, the owner of Parcel 1 shall not block <br />or otherwise prevent use of the Easement Area or place any restrictions on the Easement <br />Area so long as it is used only for the purposes provided for herein. The Trustee <br />acknowledges that there is no right or claim to any property on Parcel 1 located outside of <br />the Easement Area or for any purpose not specified herein. <br />
