<br />Fourth Subdivision and Lots One (1) and Two (2), Rainbow Lake Fifth Subdivision, Hall
<br />County, Nebraska; and
<br />WHEREAS, the undersigned is the Secretary of Rainbow Lake Homeowner's
<br />Association, Inc., a non - profit corporation, and by execution hereof, states and affirms that this
<br />Restatement is an accurate compilation of the Covenants as revised by the Addendum and
<br />Amendment.
<br />NOW, THEREFORE, the undersigned Secretary hereby ratifies and confirms this
<br />Document as the Restatement of the Agreement for Protective Covenants, Restrictions and
<br />Conditions for Rainbow Lake Subdivision, Rainbow Lake Second Subdivision, Rainbow Lake
<br />Third Subdivision, Rainbow Lake Fourth Subdivision and Rainbow Lake Fifth Subdivision in
<br />Hall County, Nebraska and any Owners, purchaser or purchasers, their heirs, successors,
<br />personal representatives, and assigns hereby stipulate and agree that any and all lots in the
<br />aforementioned Subdivisions, sold, given, transferred, and conveyed shall be, and the same are,
<br />subject to the following protective covenants, restrictions, and conditions, all of which shall run
<br />with the land as follows:
<br />1. All lots in the Rainbow Lake Subdivision, Rainbow Lake Second Subdivision,
<br />Rainbow Lake Third Subdivision, Rainbow Lake Fourth Subdivision and Rainbow Lake Fifth
<br />Subdivision, shall be zoned, described, and used as residential lots. No apartment house, duplex
<br />or triplex shall be built on any lot, nor shall any basement house be built on any lot. No dwelling
<br />shall be erected for occupancy for more than one family, nor shall any dwelling be used for
<br />occupancy of more than one family. No commercial or industrial enterprises shall be conducted
<br />or operated in said Subdivisions. No lot or lots shall be divided or split to create smaller building
<br />areas, but lots may be combined or combined and divided to establish larger building areas.
<br />2. Each building lot shall contain not more than one dwelling unit. The ground floor
<br />living space in each one -story dwelling unit shall contain not less than 1,500 square feet. Any
<br />split level or two -story dwelling unit shall have a minimum of 900 square feet on the ground
<br />floor. The minimum square footage required in this paragraph shall be exclusive of open porches
<br />and of any garage attached to the dwelling unit.
<br />3. Each dwelling unit shall contain at least an attached double garage and no more
<br />than a three -car garage, and driveway entrance from the public street in the Subdivisions.
<br />4. No building or dwelling unit shall be moved onto said Subdivisions and placed
<br />upon any building lot, such as modular homes. All dwellings shall be built from the foundation
<br />up on said lots in said Subdivisions. No trailer, mobile home, tent, garage, shack, basement or
<br />secondary buildings or any other structure of a temporary nature shall be placed as a residence or
<br />dwelling unit in said Subdivisions.
<br />5. No second building shall be permitted on any building lot in the Subdivisions,
<br />except that a boat shed may be constructed on a building lot as long as the material design, and
<br />quality of the construction is the same as that of the dwelling unit. Fences are allowed so long as
<br />they do not block any other lot owner's view of the lake from any location on any other lot.
