<br /> 7. Performance bX Lender. In the event of Borrower' s
<br /> failure to per orm any of the covenante herein or make any pay-
<br /> ment s required hereby, �r if any act ie taken or legal proceeding
<br /> conanenced whiah materially affecta Lender's intereet in �he
<br /> Property, Lender may in its own disaretion, but withont obliga-
<br /> ��,on t� d� sa, anr� �rithaut natia� ta cr 3e.�ans3 z:pon H�rr�t�er; and
<br /> without releasing Borrower from any obligation, do any aat which
<br /> the lBorrower has agreed but faila to do and may also do any other
<br /> aat it deems neaeseaxy to proteat the aecur.ity hereof. Horrower
<br /> sD�all� immediately upon demand therefor by Lender, pay to Lender
<br /> all eos�s and expenses inaurred and sums expended by Lender in
<br /> connection with the exercise by Lender ef the foregoing righte,
<br /> together with interest thereon at �he default rate provided in
<br /> the Note, which shall be added to the n e tedness secured
<br /> hereby. Lender shall not incur any liability because of anything
<br /> it may do or omit to do hereunder.
<br /> 8. Hazardous Materials. Horrower shall keep fihe
<br /> Property in aompl ance w t any and all federal, state and local
<br /> laws, ordinanaes and regula�ions relating to industrial hyqiene
<br /> or to environmen�al conditions on, under or about the Property,
<br /> including, but not limited to, soil and qroundwater conditions.
<br /> Trustor ahall nvt use, generate, manufacture, atore or dispose of
<br /> on, under or about the Property or transport to or from the
<br /> Property any flammable explosivee, radioactive materials, hazardous
<br /> wastes, toxia subetanaes or related materials, includinq, without
<br /> ].imi tation, any substances defined as or included in the defini-
<br /> tion af "hazardous substances", "hazardous wastes", "hazardous
<br /> mate rials" or "toxio substances" under any applicable lawa,
<br /> ordinances or regulations (collectively referred to here�.nafter
<br />= as '•Hazardous Materials") . Horrcwer hereby warxante and repre-
<br /> aents to Lender that there are no Hazardous Materials on or under
<br /> the Property. Borrower hereby agrees to indemnify and hold
<br /> harmlesa Lender, its directors, officers, employees and agenta,
<br /> and any suaceasQre to Lender's interest, from and against any and
<br />- all alaime, damages and liabilities ariaing in connection with
<br /> the presence, use, storage, diaposal or tranaport of any Hazardous
<br /> Materials on, under, from or abaut the Property, including, with-
<br />- out limitation, (a) all damages directly or indirec:tly arisinq

<br /> sary prior to or following transfer of ti�le to the Property, to
<br /> the �ull extent that such action is attributable, directly or
