<br />WHEREAS, a permanent easement is required by the City of Grand Island, from
<br />Niedfelt Property Management Preferred, LLC; and
<br />WHEREAS, a public hearing was held on March 26, 2013, for the purpose of
<br />discussing the proposed acquisition of such permanent easement; and
<br />WHEREAS, the following legal description details the acquired permanent easement:
<br />Niedfelt Property Management Preferred, LLC — Tract No. 2 & 4
<br />Two parcels of land located in NW '/4, of Section 12, Township 11 North, Range 10 West, Hall
<br />County, Nebraska, described as follows:

<br />Beginning at the northeast corner of Lot 1, Autumn Park Subdivision, City of Grand Island, Hall
<br />County, Nebraska; thence northerly along the west line of City of Grand Island Drainage Right -of-
<br />Way, a distance of 446.95 feet; thence westerly deflecting 90 00'00" left, a distance of 12.00 feet;
<br />thence southerly deflecting 90 00'00" left, a distance of 446.95 feet to the north line of said Lot 1;
<br />thence easterly along the north line of said Lot 1, deflecting 90 00'00" left, a distance of 12.00 feet to
<br />the Point of Beginning, containing 5,363.40 square feet, more or less.

<br />Beginning at the southeast corner of Lot 1, Sterling Estates Second Subdivision, City of Grand
<br />Island, Hall County, Nebraska; thence westerly along the south line of said Lot 1, a distance of 12.00
<br />feet; thence southerly deflecting 91 15'04" left, a distance of 443.93 feet; thence easterly deflecting
<br />90 00'00" left, a distance of 12.00 feet to the west line of City of Grand Island Drainage Right -of-
<br />Way; thence northerly along the west line of City of Grand Island Drainage Right -of -Way, deflecting
<br />90 00'00" left, a distance of 443.63 feet to the Point of Beginning, containing 5,325.61 square feet,
<br />more or less.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
<br />THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
<br />authorized to acquire the necessary permanent easement from Niedfelt Property Management
<br />Preferred, LLC, on the above described tracts of land, in the amount of $970.00.
