<br /> nceived or collected by Tcustar or any of the partners of Trustor and not dellvered to
<br /> Beneficiary or any payments or othcr consldoratlon for the modificatlon, amendment,
<br /> essignment, cancellatlon or termination of any such lease (whether entire or partial) are
<br /> ncelved or colltcted by Trustor or any of tha part��ers of Trustor and are not delivered to
<br /> ' Beneficiary;
<br /> (5) All restoration funds,insurance proceeds end condemnation awards wtth respect to the
<br /> -�� Trust Property which are not applied in a�ccordance with the provisions of the loan doc:uments,
<br /> � as well as any expendite�res�damag�s ar costs incurred by Beneficiary as a result of such
<br /> � misapplication;
<br /> . (6)Any and all of Beneficlary°s costs,expenses,damages or liabilitles�di�A nr�In��cle
<br /> � arising out of or attrlbutable to the use, generation, storage, rel�ase,
<br /> • discharge or disposal on� under or about tbe Trust Pcoperty of any mater�al, wswstes or
<br /> substances defined or classified as hazardous or toxic under federal,atate or local laws or
<br /> � ragulations or otherwise artsing as a result of(a) a breach of Secdon A.3 of the Dead of Trust
<br /> or(b) any of the applicable represeatations and waaantles in t�e Deed of'Y'rust being false;

<br /> � (7)Real estate taxes and assessments�u►d inaurance premiums,due,acerued or payable up
<br /> �'� until the time that Bcneficiary is vested in fee title owncrsk►ip of the Trust Property.
<br /> (d) As used herein,costs and eapenses shell include�but not be limited to attornay fees and
<br /> costs,whather tncurred at trlal,on appeal or discntionary review or otherwise. Trustor and the
<br /> partners of Trustvr,and each of them,jointly and severaliy promise to pay to Beneficiary all amounts
<br /> d�ribed in subparag�raph 23.(b)and claus�s 23.(c)(1) through(7)above on domand by B�neficiary
<br /> and agree to be personally liable for payment of all such sums,wlthout regard to the lim�tarion of
<br /> lisbillry in subparagraph 23.(a). Bencficiary shall be entitled to a judgment agaii►st Ttustor and the
<br /> partners of Trustor, and each of them,jointly and sevcrally in an amount equal to the total of all
<br /> � � amaunts descrlbed in clauses 23.(c)(1) through(7)above,together with the amount descdbed in
<br /> � subpazagraph 23.(b)above.
<br /> �� 24, DlsseminAtion oi Indorm4tion.If&neficiary detemunes at any dme to scU,transfer
<br /> or assign the Note or this Deed of Trust and the other sccuriry dacuments,and any or all sorvicing
<br /> : rights wlth respect ther�to, or to grant partieiparions thenin� Beneficiary may provide to any
<br /> ; prospecdve purchaser, transferee, assigne�. Pardcipant or rating agency and their agents and
<br /> � successors,all documents and information BeneficlarY now has or may hereafter acquire reladng to
