<br /> ' (a) Without in a�ry manner releasing,impai�'ing or otherwise affecting tho Nou,this Deed of
<br /> Trust or any other instrurnent securing the Note or the validity thereof or hereof or thc lien thereof and
<br /> �xcept for tbe recourse set forth in subparagraphs 23.(b)and 23.(c)below,Beneftciary agrecs not to
<br /> � sak a deficiency judgment against Trnstor or any of the partners of Trustor.
<br /> � (b) �Jotwlthstanding tbe 1 imltadon of liability in subparagraph 23.(a)�TivsWr, aad th�partners
<br /> of Trustor,and each of thom,jointly and severally shall remain personally liable and promise to pay
<br /> • Heneficiary twenty-five percent�2S°•�n)of the outstanding laan balance(includ�ng but not limited to
<br /> f principal.delinquent interest,late charges and any other amounts advanced by B�noficiary under the
<br /> "• Note or this Deed of Trust) at thc time the judgment is entend, or in the case of a nonjudicial
<br /> foreclosure,at the time of sale.
<br /> � (c) Notwithstanding the 13autation of liability in subparagraph 23.(a),and in addidon to the
<br /> ����;�n�ced under subpara�raph 23.(b),Trustor,and the partners of Trustor,and each of them,
<br /> jointly and scvtrally shall remain personally liable and prornise to pay Bene�iciary for the folIowing:
<br /> .� (1)All loss. damage,costs and expense suffered by Beneficiary as a rosult of(a) fraud or
<br /> misrepresentadon by Tn�.stor or any of tho partners of Trustor,or(b)intentional or neglig�nt
<br /> � waste to the Trust Property;
<br /> (2)All rents,nvenues,issues and profits from the T�ust Pc+opeity(a)roceived during a peciod
<br /> of any default under the loan documents,or after acceleration of the indebtedness and other
<br /> swns owIng under the loan dceuments,and(b)not applir.d to payment of such indebtedness
<br /> or to paytnent of noza�aal aperadng expenses of the Tn�st Propotty,as well as anY�xP����
<br /> ,
<br /> damages or costs incurned by Beneficiary as a result of such misapplication;

<br /> �`{ (3)All rents and securiry deposits from the Trust Property collected more than onc month in
<br /> �'��� advance which are not earrsed at the time of occurrence of any default under tha loan
<br /> ; � documents and wh�ch are not applied to payment of such indebtedness or to payment of the
<br /> �� normal operadag exp�enses of the Tn�.st Property.as well as�ny expenditures.damages or costs
<br /> � incurred by Bon�ficiary as a nsult of such misapplication;
<br /> . (4)Any payments or other consideradon,less reasonable costs of collection thereof, including
