<br /> 1.9 Transfer or Eacumbrance of the Property. Except as pernutted by
<br /> the I.oan Agreement, Otantor shall not permit or suffer to occur any sale� assigainent,
<br /> conve�yanca. traasfer, mortgage, lease (�ther then leases mi�tda in accordance with the
<br /> provisions of tlue Deed of Trust)or encumbrance of(other then Pernutted Encumbrances), or
<br /> any contract for aay of the foregoing on�n installment basxa or otherwise pertaining to, ttie
<br /> Property, any part thereof, any interest therein, without the prior written consent of Lender
<br /> having been obtained.
<br /> 1.10 Furthtr Adsuruaca�. At any time aad fram time to�mme�upan Lender's
<br /> request,Grentor shaU make,execute and deliver,or cause to be made,executed and delivered,
<br /> to Lender,and where appropriate shall causa to be recorded,registered or filcd,aad from time
<br /> tu time thereafter to ba re-reaorded, re-registered and r�filed at such time aad in such ot�ices =
<br /> and places as shall be deemed desirable by Lender, any and all such fuctl�er mortgages or
<br /> deeds of truat, security agreements, fmancing statemeata, inatruments of further assurance,
<br /> certifica4�es and ather documents as L.�nder may consider necessaiy or desitable in ordar to
<br /> effectuate or perfcct,or to continue and preserve the obligations under,tlsie Dad of Trust.
<br /> 1.11 Assignmeat of Rente. 'Tt�e sssignment of rents, income and otha
<br /> benefits contained in Section(E) of the Granting Clauses of this Deed of Trust shall be fulty
<br /> operative without airy further actioa on the part of either party, and, specificatly, Lendei'shaU
<br /> ba entitled, at its opri.on,as e matter of right and without order of court,upon the occuneeice
<br /> of an Event of Def�ult hereunder ead during the continuaace of such Eveat of Default, to
<br /> receive directl.y from lesseas,teaaats a�►d occupeata of the prop�scty all reata, income aad other
<br /> benefita�rom the Property,upon service of written notice oi the oxerciee of'uua anni�i►uc+��of
<br /> rents upon such lessees� tenants ead occupants by Leada, whether or not L�eader takes

<br /> Loans are paid in full aad the Loan Instruments have been terminated, the execution of tlus
<br /> Deai of Trust constituting and evidenaing the irrevocable conseat of(irautor to the eatry
<br /> upon aad taking poasession of the Property by Lender pursuaat to such g�aat,whetha or not
<br /> foreclosure proceedings have been instituted. Notwithstanding the forcgoing, so long aa no
<br /> Event of Default has occurred or is continuing. Qraator shall hsve the right md authority to
<br /> continue to colleat the re�ts,income and other benef'its from tho Property as they become due
<br /> and payeble aad to retain,use and enjoy the same but not more thaa thirlY (3U) daYa prior to
<br /> the due date thareo� Lender shall not be damed a"mortgegee in posseuion"unless Lender
<br />� actually eatecs upoa and takes possession nf tho Properiy.
<br /> 1.12 Aner-Acquired Property. To the ext�nt permitted by,end subjcct to,
<br /> � appGcable lew,the lien of this Deed of Trust shall automatically attaeh,without further act,to
<br /> all personal properly hereaR�r acquired by(3rantor located in or on,or sstta�chtd to, or used or
<br /> - intended to be used in connection with, or with the operation of, the Progaciy or any part
<br /> � thareof.
<br /> = 1.13 Leases AfficNng Prnperty. Grautor shall comply with and perfonn in
