<br /> Lender is hereby authorized and empowered, at its option, to adjust or cempromise emy losa
<br /> under aay insuranca pali�ies covering the Property and to collect end receive the prQCeede
<br /> from any such policy or policias.
<br /> 1.6.3 Condemnatiow Aw�rda. Lendcr shall be entitled to all compensation,
<br /> awards,demages,claims,rip,hts of actioa and praceeds of,nr on account af, (i)any damage or
<br /> taking, pursuant to the power of eminent domain, of tho Property or any part thereof, (ii)
<br /> damage to the�'ropetty by reason of tlie taking,pursuaat to the power of eminent domain, of
<br /> other propr.rty, �r (iii) the alteration of the grade of auy street or highway on or aboat thn
<br /> Property. Lander ia hereby authorized,at its option,tn cammenca appear in and prosecute in
<br /> its own or Cirantor's name any action or proceeding relating ta any such comp�nsation,
<br /> awerds,damages,claims,rights of action and proceed�aad to settle or compromisc any claim
<br /> in coru►ection therewitb.
<br /> 1.6.4 REpair; Procecds ot Ca�udty Ias�arAnce �end Erainent Dom�utn. If
<br /> all or aay part of the Property shell be damagad or destr�Y�ed bY fire or othGr casualty or shall
<br /> be damaged or tak�n through tho exercise of tlYe power of Gmineat domsin or other cause
<br /> d�acr�hed in Section 1.6.3, (3rantor shall promptly and with all due diligence restore aad
<br /> r�pair the Properly whethcr or not the proceeds, awerd or other aompanaatio� are cnade
<br /> � aveilable to Cnantor or aze sufficient to pay the cost of such restaration or repair. The entire

<br /> �` 1.7 Lender 1VI�y Pay. Upon Orantor's feilure tn pay any amount required
<br /> to be paid by f�raator uuder Sections I.4, 1.5 aad l.b.l, Lender may pay the sa�ne• Gre�nWr
<br /> shaU pay to Lender on demaad the anxount so paid by Lender together with intaest et the
<br /> �+ Default Rate(as such tarm is defi�aed in the Loan Agreement) and the amount eo ptid by

<br /> 1.8 Care otthe Properly. Ga'antor shall preserve and maintaia the Property
<br /> � in good condition and repair. Cirantor shall not,without the prior wr�tten consent of Lendar,
<br /> � � PQ�i�,commit or guff�r any waste, impairmesit or deterioration of the Praparty or of any part
<br /> � thereof, and will not take aay aotion which will increase th�risk of fire or other hazard to the
<br /> Property or to sny part tlxcrcof. Except as otharvviee provided in this D�eed of Trust or the
<br /> Loan Agreemeat, no part of the Property sha11 be ranoved, demolished or altered ia sny
<br /> rnaterial maaner without the prior written coaseat of Leader. Lender's conseat shall not be
<br /> withheld, provided that the making of such alterations will not violate any provision of the
<br /> Loan Agreement and Lender is satisfied in its sole judgment that the value of the Propecty will
<br /> not bo diminished by the making of such alterations.
