ROBERTSON AND <br />CONNIE L. ROBERTSON, CO- TRUSTEES OF THE ROBERTSON FAMILY TRUST, <br />DATED JULY 19, 2006, hereinafter referred to as Grantees. <br />a. Grantor is the owner of a certain tract of land comprising of a part of the <br />Southeast Quarter of the Northwest Quarter (SEl /a NW1/4) of Section <br />Twenty -Four (24), Township Eleven (11) North, Range Nine (9) West of <br />the 6th P.M., Hall County, Nebraska. <br />b. Grantees are the owners of a certain parcel of land located on a tract of <br />land comprising a part of the Southeast Quarter of the Northwest Quarter <br />(SEl /a NWl /a) of Section Twenty -Four (24), Township Eleven (11) North, <br />Range Nine (9) West of the 6 P.M., Hall County, Nebraska. <br />c. Grantor has agreed with Grantees to grant Grantees a perpetual <br />nonexclusive easement for ingress and egress for agricultural purposes in <br />favor of the appurtenant to Grantees' partial over and across a 30 -foot strip <br />running parallel to the north property line of the Burlington Northern <br />Santa Fe railroad right -of -way. <br />NOW, THEREFORE, for and in consideration of the premises and other good and <br />valuable consideration receipt and sufficiency are hereby acknowledged, the parties hereby agree <br />as follows: <br />1. RECITALS. The foregoing recitals are true and correct and are incorporated <br />herein by this reference. <br />2. GRANT. Grantor hereby grants to Grantees a perpetual nonexclusive <br />easement for ingress and egress for agricultural purposes in favor of and appurtenant to <br />Grantees' partial over and across a 30 foot strip running parallel to the north property line of the <br />Burlington Northern Santa Fe railroad right -of -way. <br />3. MAINTENANCE AND USE OF ACCESS EASEMENT. Grantees shall <br />maintain and use Grantor's parcel (access easement) in such way that the same shall not <br />unreasonably interfere with the normal customary use of Grantor's parcel by Grantor. <br />Grantees and Grantor agree that all costs to create, maintain, or improve said easement <br />shall be shared equally between Grantor and Grantees. <br />
