WHEREAS, pursuant to Section 21 of the Restrictive Covenants, the Restrictive
<br />Covenants may be changed or modified by a vote of a majority of the Owners of the lots that
<br />comprise the Subject Property. As such, a majority of the Owners of the lots that comprise the
<br />Subject Property must approve said variance.
<br />NOW, THEREFORE, it is agreed as follows:
<br />1. Incorporation of Recitals. The recitals appearing hereinabove are hereby
<br />specifically incorporated herein and made a binding part of this Agreement by this reference.
<br />2. Approval of Variance. The parties hereto, being a majority of the Owners of the
<br />lots that comprise the Subject Property, do hereby approve the above - referenced desired variance
<br />to the Restrictive Covenants for Lot One (1), Block Four (4), Sterling Estates Subdivision in the
<br />City of Grand Island, Hall County, Nebraska, thereby allowing a detached garage or outbuilding
<br />that is 30' wide and 50' deep to be erected or built on said Lot.
<br />3. Continuing Effect. Except as modified hereby, the Restrictive Covenants,
<br />including all other provisions of Section 10 thereof, shall remain in effect and be applicable to
<br />Lot One (1), Block Four (4), Sterling Estates Subdivision in the City of Grand Island, Hall
<br />County, Nebraska.
<br />4. Binding Effect. This Variance to the Restrictive Covenants, Restrictions and
<br />Conditions shall be binding upon and shall inure to the benefit of the parties hereto, their legal
<br />representatives, successors and assigns.
<br />IN WITNESS WHEREOF, the parties hereto have executed this Variance to the
<br />Restrictive Covenants, Restrictions and Conditions on the dates noted hereinbelow.
