201210442 <br />5. Payment of Utilities: Taxes. Lessee shall pay all charges for the furnishing of gas, electricity, <br />and other public utilities for the irrigation equipment. Lessor shall pay all real and personal <br />property taxes. <br />6. Waste or Nuisance. Lessee shall not commit or permit the commission by others of any <br />waste on the Property or use or permit the use of the Property for any unlawful purpose. <br />7. Insurance Hazards. Lessee shall not commit or permit the commission of any hazardous acts <br />on the Property nor use or permit its use in any manner that will increase the existing rates for or <br />cause the cancellation of any fire, liability, or other insurance policy insuring the Property, and <br />the crops and improvements thereon. Lessee shall, at his expense, comply with all requirements <br />of Lessor's insurance carriers reasonable necessary for the continued maintenance at reasonable <br />rates of reasonable fire and liability insurance on the Property and the improvements and crops <br />thereon. <br />8. Maintenance. Lessee shall, except as otherwise provided for in this lease at his expense, <br />keep and maintain the Property, all improvements thereon, and all facilities appurtenant thereto <br />in good order and repair and in as safe and clean a condition as they were when received by him <br />from the Lessor, reasonable wear and tear excepted. <br />9. Alterations and Liens. Lessee shall not, without Lessor's prior written consent, make or <br />permit any other person to make, any alternations to the Property, or to any improvement thereon <br />or facility appurtenant thereto. Lessee shall keep the Property free and clear from all liens, <br />claims, and demands for work performed, materials furnished, or operations conducted thereon <br />by Lessee or at his request. <br />10. Inspection by Lessor. Lessee shall permit Lessor or his agents, representatives, or <br />employees to enter the Property at all reasonable times in order to inspect the Property to <br />determine whether Lessee is complying with the terms of this Lease, and to do all other lawful <br />acts that are necessary to protect Lessor's interest in the Property. <br />11. Acceptance by Lessee. Lessee accepts the Property, as well as the improvements thereon <br />and the facilities appurtenant thereto, in their present condition. Lessee warrants and represents <br />to the Lessor that Lessee has inspected the Property, that Lessee has been assured by means <br />independent of Lessor or Lessor's agents of truth of all facts material to this Lease, and that <br />Lessee is leasing the Property as a result of his inspection and investigation and not of any <br />representation made by Lessor or his agents. <br />12. Hold Harmless. Lessee shall indemnify and hold Lessor and the Property free and harmless <br />from all claims, liability, loss, damage, or expense resulting from Lessee's occupation and use of <br />the Property, including, without limitation, any claim, liability, loss, or damage arising by reason <br />of: <br />a) Any injury to person or property, from whatever cause, while in or on the Property or in any <br />way connected with the Property or with the improvements or personal property therein or <br />
