IN) N R <br />N <br />CRAIG WHITE AND VONNIE WHITE, husband and wife and CNC Investment Properties , <br />L.L.C. a Nebraska Limited Liability Company, (collectively "Lessor ") hereby leases to JSH <br />Farms Inc., a Nebraska Corporation ( "Lessee ") the real property (the "Property "), legally <br />described as the NW 1/4 12 -9 -10 all in Hall County, Nebraska, consisting of 123.22 acres, more <br />or less, together with all buildings and improvements thereon including the irrigation equipment, <br />on the following terms and conditions. <br />1. Term of Lease. The term of this lease ( "Lease ") shall be for a period of one year, <br />commencing on January 1, 2013 and ending on December 31, 2013 ( "the Lease Term "). <br />2. Rent. Lessee shall pay to Lessor as rent for the use and possession of the Property the sum of <br />$36,966.00 for the Lease Term, $18,483.00 of which shall be payable on March 1 of the Lease <br />Term, and $18,483.00 of which shall be payable on December 1 of the Lease Term. The Lease <br />shall not continue in effect after the Lease Term without the written consent of Lessor. <br />3. Use of Premises. The Property shall be used for agricultural and related purposes only. <br />4. Operations on Premises. All operations conducted on the Property by Lessee as incidents of <br />any use specified in Paragraph 3 of this Lease shall be in accordance with the best course of <br />husbandry practiced in the county of the Property. If Lessee fails to perform any of such <br />obligations in the prescribed manner, after Lessor shall have given Lessee 10 days written notice <br />of such failure (as provided in Paragraph 18), Lessor may enter the Property and take whatever <br />action is reasonably necessary to protect Lessor's interest therein and in this Lease. Lessee shall <br />reimburse Lessor on demand for the cost of any action Lessor may take under the provisions of <br />this paragraph. Lessor will supply all irrigation equipment in good working order. Lessee, <br />however, shall pay for all labor on irrigation equipment for repairs required by Lessee during the <br />Lease Term. Lessor shall pay for all irrigation equipment parts. Lessee shall pay for seasonal <br />service of all irrigation equipment. <br />3059 <br />
