JOHNSON TESTAMENTARY TRUST The undersigned, being first duly sworn upon oath, deposes, states and declares as follows: The Southeast Quarter (SE /4) of Section Thirty-six (36), Township Nine (9) North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, EXCEPT that portion previously deeded to the State of Nebraska for road purposes, as shown by a Deed recorded in Book 77, at Page 494, FURTHER EXCEPTING a tract deeded to Lincoln Telephone and Telegraph Company, legally described as follows: Commencing at a point in the Southeast Quarter (SE /4) of said section where the West right -of -way line of Highway 281 (as part of the right -of -way for said Highway is deeded to the State of Nebraska, by deed in Book 77 at Page 494 of the Deed Records of Hall County, Nebraska) intersects the North line of the Adams -Hall County Highway bordering said 1. The Harriett M. Johnson Testamentary Trust (hereinafter "Trust ") was created pursuant to Paragraph Fifth of the Last Will and Testament of Harriett M. Johnson dated January 16, 1998 and Robert L. Johnson and Gwen K. Thorpe were designated as the initial Co- Trustees of the Trust. The Trust is irrevocable due to the death of the decedent, Harriett M. Johnson, on September 9, 2010. 2. From the date of the creation of the Trust the Affiant has served as Co- Trustee and as of the date hereof is currently serving as a Co- Trustee of said Trust which Trust grants the Co- Trustees all powers granted to Trustees under Nebraska law. The Internal Revenue Service has issued a taxpayer identification number for the Trust and the Co Trustees file annual fiduciary income tax returns for the Trust. 4.
