�0120�39� <br />6. Occupancy. Borrower sha11 occupy, e,stablish, and uae the Property as Borrower' s principal residence <br />�ithin 60 days after the exe�ntion of tlus Security Instniment and shall continue to occupy the Properiy as <br />Borrower' s principal residence for at least one year after the date of occupancy, unless Lender othervvise <br />agrees in writing, wluch consent sha11 not be unreasonably withheld, or unless extenuating circumstancas <br />exist wluch are beyond Bonower' s control. <br />7. Preservation, Mahttenanca and Protectfon of the Properly; Ir�pections. Borrower shall not destroy, <br />damage or impair the Properiy, allow the Properl}+ to deteriorate or commit waste on the Property. Whether <br />or not Boaower is residing in the Properiy, Bonower shall maintain the Property in order to prevent the <br />Froperty from deteriorating or d�reasing in value due to its condition. Unless it is determined pursuant to <br />Section 5 that repair or restoration is not aconomically feasible, Borrower shall promptly repair the Property <br />if damaged to avoid further deterioratian or damage. If insuranca or condemnation proceads ara paid 'm <br />c�nnection with damage to, or the taking of, the Property, Borrower shall be responsible for repau�ing or <br />restoring the Properiy only if Lender has released proceeds for such purposes. Lender may disbursa proceeds <br />for the repairs and restoration in a single payment or in a series of pro�s payments as the work is <br />completed. If the insurance or candemnation proceeds are not sufficient to repair or restore the Property, <br />Borrower is not relieved of Borrower' s obligation for tha completion of such repair or restoration. <br />L�nder or its agent may make reasonable entries upon and inspections of the Properiy. If it has reasonabla <br />c�use, Lender may inspe�t the interiar of tha improvements on the Property. Lender shall give Borrower <br />nutice at the time of or prior to such an interior inspection sp�ifying such reasonable cause. <br />8. �orrower'� L�oan Appllcation. Borrower sha11 be in default i� during the Loan application process, <br />Boaower or any persons or entities acting at the direcbion of Borrower ar with Borrower's knowledge or <br />consent gave materially false, misleading, or inaccurate infornoation or statements to Leader (or failed to <br />provide Lender with material information) in connection with the Loan. Material representations include, but <br />ar. e not limited to, representations concerning Borrower' s occupancy of the Property as Borrower' s principal <br />Tesidence. <br />9. �tectlon af Lender's Inter�est In the Property and I�ghts Under this S�curity Instrument. If (a) <br />Borrower fails to perform the covenaats and agr�ments contained in this Security �t, (b) there is a <br />l�ga1 proc�eding that might significantly affect Lender's interest in the Property and/or rights vnder this <br />S�urity Inst�ment (such as a praceeding in banlQUptcy, probate, for condemnarion ar forfeitUra, for <br />enforcement of a lien which may attain priority over this Security Instcvment or to enforce laws or <br />regulations), or (c) Bonower has abandoned the Properiy, then Lend� may do and pay for whatev� is <br />reasonable or appropriate to protect Lender' s interest in the Properly and rights under tlus Security <br />Instrument, including protecting and/or asaeasing the value of the Property, and securing and/ar repairing <br />t�ae Property. Lender' s actions can include, but aze not limited to: (a) paying any simos secured by a lien <br />which has priority over this Sacurity Instrument; (b) appearing in court; and (cj paying reasonable attorneys' <br />fees to prote,ct its interest in the Properiy and/or rights under this Se�urity InsUvment, including its se�ured <br />position in a bankruptcy proc�eding. Securing the Property includes, but is not limited to, entering the <br />PropErty to make repairs, change locks, replace or board up doors and windows, drain water from pipes, <br />eliminate building ar other code violations or dangerous conditions, and have utilities turned on or off. <br />Although L�nder may take action under this Section 9, Lender does not have to do so and is not under any <br />duty or obligation to do so.
