<br /> 21. Hazardous Substances. As used in this Section 21: (a) "Hazardozr,s Substances" are those substanccs
<br /> defined as toxic or hazardous substances, pollutants, or wastes 6y Environmcntal law and the following
<br /> substances: gasoline, kerosene, od�er f7ammable or toxic petroleum products, toxic pesticides and herbicides,
<br /> volatilc solvents, materials containing asbestos or formaldelryde, and radioactive materials, (b)
<br /> "F.rrvironmental Law" mcans federal laws and laws of the jurisdiction whcre the Property is located that
<br /> relate to health, safety or enviroi�men[al protection; (c) "Eirvirovanzental Clea�rup" includes any response
<br /> action, remcdial action, or remov�l aetion, as definul in F.nvironmental Law; and (d) an "Envi�^onmental
<br /> Condition" means a condition Lhat can cause, contribute to, or otherwise triggcr an F.nvironmental Cleanup_
<br /> 6orrower shall noC cause or permi[ the presence, use, disposal, storage, oe rclease of any Hazardous
<br /> Substances, or threaten to release any Haurdous Substances, on or in the Properry. Borrower shall not do,
<br /> nor a11ow ai�yone elsc to do, anything affecCing the Yroperry (a) that is io violation of any Environmental
<br /> Law, (b) which creates an Environmental Condition, or (c)which, due Co the presencc, use, or release of a
<br /> Tiazardons Substance, creates a condition that advicesely affecfs the value of the Property. The peeccding two
<br /> sentences shall not apply to thc presence, use, or storage on the Proper[y of sinall quantifies of Hazardous
<br /> Substances Ll�at are geneially recognized to be appropriatc to norinal residential uses and to mainLenance of
<br /> the Property(incl�ding, but not limited to, hazardous substanccs in consumer products),
<br /> Rorrower shall promptly givc Lender written notice of(a) any investigation, claim, demand, lawsuit or other
<br /> aetioi� 6y any governmental or regulatory agcncy or private party involving the Property and any Hazardous
<br /> SubsCance or Cnvironmental I_,aw of which Borrower has ac[ual knowledge, (b) any Environmental
<br /> Condition, including but not limited to, any spilling, leaking, discharge, releasc or threat of release of any
<br /> Harurdous Substance, and (c) any condition caused by the presence, use or release of a Hazardous Substance
<br /> which adversely affeces thc value ofthe Property. lf Borrowcr laarns, or is noGified by any governmental or
<br /> regulatory auYliority, or ai�y F�rivafe party, that any removal or other remcdiation of any HazarAous Substance
<br /> affec[ing the Property is neeessary, Borrower shall promptly take all necessary remedial actions in
<br /> accordance with Environmentaf Law. Nothing herein shall create any obligation on Lender for 1n
<br /> EnvironmenYal Cleanup.
<br /> Non-Uniform Covenants. Borrower and Lender covenant and agree as follows:
<br /> 22. Acceleratlon; Remedies. Lender shall give notice to 6orrower prim•tu acceleration following
<br /> ►3orrower's breuch of any covenant or agreemen[ in YLis Securi[y [nstrument(but not prior to
<br /> acceleration under Section ]8 unless Applicable Law pruvides otherwise). Thc notice shall specify: (a)
<br /> the defpult; (b) the action reyuired to cure the defaulh, (c) a date, not less t�un 30 days irom the dale
<br /> the notice is given to Borrower, by which the defuidt musf be cured; and (d) that f•ailure to cure the
<br /> default on or before the date specified in thc ootice may result in accelerution of the sums secured hy
<br /> this Security [nsYrument and sale of the Property. Thc nofice shall f'urther inform Borrowcr of the
<br /> right Co reinstxte after acceleration and Ehe right to bring a eourt action to assert the non-existeoce of u
<br /> default or any other defense of Borrowcr to accelerafion and sale. If the Acfault is not cured on or
<br /> before the datc specifed in the uotice, Lendcr at its option may require immediate paymcnt in full of
<br /> all sums secured by this Security Instrument wit6out furtNer demand and may iuvoke the power of salc
<br /> and any other remedies permitted by Applicable Law. Lender shall be entitled to collect alI expenses
<br /> iocurred in pursuing fhe remedies provided in this Section 22, including, but not liroited to, reasonxble
<br /> attorneys' fees and costs of title evidence.
