201207846 <br /> 6. Occupancy. Borrower shall occupy, establish, and use the Property as Borrower's principal residence <br /> wlthin 60 days afrer [he exewtion of[his Security Instrument and shall continue to occupy tLe Property as <br /> Borrower's principal restdence for at least one year after the date of occupancy, unless Lender otherwise <br /> agrees in wriUng, which consen[ shall not be unreasonably withheld, or unless e�rtenuating circwnstances <br /> exist which are beyond Borrower's control. <br /> 7. Preservation, Maintenance and Protection of the Property; Inspections. Borrower shall no[ des�roy, <br /> darrtage or impair the Properly, allow the Property [o deteriora[e or commit was[e on the Property. Whether <br /> or not Borrower is residing in the Property, Borrower shall maintain the Propetty in order to prevent [he <br /> Property from deteriorating or decreasing in value due to i[s condiflon. Unless it is determined pursuant to <br /> Section 5 that repair or restoraflon is not economically feasible, Borrower shall promptly repair the Property <br /> if damaged to avoid further deterioralion or damage. If insutance or condemnahon proceeds are paid in <br /> connecUon with damage to, or the taking of, the Property, Borrower shall be cesponsible for repairing or <br /> restoring the Property only if Lender has released proceeds for such purposes. Lender may dlsburse proceeds <br /> for the cepairs and resroradon in a single payment or in a series of progress payments as the work ls <br /> completed. If the insurance or condemnafion proceeds are not sufficient to repair or restore �lte Property, <br /> Borrower is not relieved oF Bormwer's obligation for the comple[ion of such repair or resroration. <br /> Lender or its agent may make reasonable enUies upon and inspecUons of the Property. If it has reasonable <br /> cause, Lender may inspect Ihe interior of Ihe impmvements on fhe Property. Lender shall give Borrower <br /> nouce at the t3me of or prior to such an interior inspecflon specifying such reasonable cause. <br /> 8. Borrower'S Loan Application. Bonower shall be in default if, during the Loau appllcation process, <br /> Borrower or any persons or entities acting at the direcflon of Borrower or with Borrower's knowledge or <br /> consent gave materially false, misleading, or lnaccurate informaflon or statements to Lender (or failed to <br /> provide Lender witH material informatlon) in connectlon with the Loan. Matedat representations include, but <br /> are not limited to, representations wnceming Borrower's occupancy of the Property as Borrower's principal <br /> residence. <br /> 9. Protection of Lender's Interest in the Property and Rights Under this Security Instrument. If(a) <br /> Borrower fails to perform the covenan[s and agreements contained in this Security Instrument, (b) Were is a <br /> legal proceeding Wat migltt significanfly affect Lender's interest In the Property and/or dghts under this <br /> Secarity Instrument (such as a proceeding in bankruptcy, probate. Lender's actions can iuclude, but are not limited to: (a) paying any sums secured by a lien <br /> which has priorily over this Security Instrumenh, (b) appearing in court; and (c) paying reasonable at[omeys' <br /> fees to protect its interest in the Property and/or rights under this Security Instrument, including its secured <br /> posiflon in a bankruptcy proceeding. Secwting the Properly includes, but is not limi[ed to, entering [he <br /> Property to make repairs, change locks, replace or board up doors and windows, drain water from pipes, <br /> eliminate building or other code violations or dangerous conditions, and have utllities tumed on or aff. <br /> Although Lender may take acflon under this Section 9, Lender does no[ have to do so and is not under any <br /> duty or obligation to do so.
