<br /> 21. HaZal'dous Substances. As used in this Section 21: (a) "Hazardous S�uhstaraces"arc thosc subsCances
<br /> defined as toxic or hazardous substances, pollutnnts, or wastes by Environmcntal Law and the following
<br /> substances: gasoline, kerosene, oCher flammable or toxic petroleum products, toxic pesYicides and herbicides,
<br /> volatile solvents, materfals containing asUesros or formaldehyde, and radioactive materials; (6)
<br /> "F.nvironmental Luiv"means federal laws and laws of thejurisdiction where the Property is located[hat
<br /> relate to healYh, safery or emiromnental protecNon; (c) "F,nvironmefzaal Clearrup" includes any response
<br /> action, remedial acCion, or removal action, as dctined in Environmental Law; and(d)an "Gnv7ronmenta[
<br /> Condrtion"inenns a condition fJiat can cause, contribute to, or otherwise trigger an F.nvironmental Cleanup.
<br /> Borrower shall not cause or pennit the preseuce, use, disposal, sforage, or release of a�ry Hazardous
<br /> Substances, or threaten to release any Hazardous Substances, on or in the Property. Borrower shall hot do,
<br /> nor allow anyone else to do, anything affecting the Properly(a) theC is in violation of aery Environmental �
<br /> Law, (b)which creates an EnvironmentaL Conditio�, or(c)which, due to khe presence, use, or release of a
<br /> Hazardous Substance, creates a coudition that adversely affects the value of tlic Property. The preceding Ywo
<br /> sentences shall not apply to the presence, use, or s[orage on the Property of small quantities of Hazardous
<br /> Substances that are geuerally recognized to be appropriate to normal residential uses and to maintieuance of
<br /> the Properiy (ineluding, but noC limited tq hazardous substances in consmncr products).
<br /> Borrower shall promptly give Lender wriCten notice of(a) any investigation, claim, demand, lawsuit or other
<br /> action by any governmental or regulatory agcncy or private party involving thc Property and any Hazardous �
<br /> Substance or Environmental Law of which Borrower has ectaal k�owledge, (b)auy Environmental
<br /> Condition, including Uut not limited to, any spilling, leaking, discharge, release or threat of relcase o1'any
<br /> Hazardous Substance, and (c)any condition caused by the presence, use or relcase of a Hazardous Substance
<br /> which adverscly affects fhe value of the Properry. If Barrower learns, or is notified by any governmental or
<br /> regulatory authority, or any privafe party, that any removal or other remediation oF any Hazardous Substance
<br /> affecting the Properry is necessary, Rorrower shall promptly ta[ce all necessary remedial actions in
<br /> accordance with Fnvironmen[al Law. Notl�ing herein shall create any obligation on Lender for an
<br /> Euvironmental Cleanup.
<br /> Non-Uniform Covenants. Borrower and Lender covenant and agree as follows:
<br /> 22. AcGBIBrBtIOn; Remedies. Lender shall give notice to Borrower prior to acceler:�tion following
<br /> Borrower's breach of any coveu:�nt or agreement in this Security Instrumenf(but not prior to
<br /> accelera6on under Section 18 unless Applicable Law provides othcrwise). The notice shall speciSy: (a)
<br /> the default; (b) the action required to cure Yhe default (c)a dnte, not less fhan 30 days from the date
<br /> the notice is given fo Borrower, by which the default must be cured; and(d) thaf failure to cure the
<br /> default on ar before the date specified in the notice may resulf in acccleration oF the sums secured by
<br /> this Security histrnment and sale of the Property. The notice shall further inform Borrower of the
<br /> right to reinstate after acecleration and the right to bring:�court acfion to assert the non-existence of:�
<br /> defaulC or any other defense of Rorrowcr to acceleration and sale. If the default is not cured on or
<br /> beforc Yhc date specif7ed in the notice, Leuder at its option may require immediaYe payment in full of
<br /> ell sums secured by this Security Iustrument without fuMher demand and may invoke the power of sale
<br /> and any other remedies permittcd by Appiicablc Law. Lender shall be enfitled to collect all expenses
<br /> incurred in pursuing the remedies provided in this Scction 22, including, but not limited to, rcasonable
<br /> attorneys' fees and cosfs of Yifle evidence.
