20120654� <br />2. Truck Scale. Grantor and Grantee acknowledge and agree that <br />both parties will be permitted to use the truck scale. Grantor and Grantee agree <br />that the parties may establish reasonable rules and regulations to govern the use <br />of the truck scale. Both parties shall be required to consent to the rules and <br />regulations governing such use. Consent to such rules and regulations shall not <br />be unreasonably withheld. Any rules and regulations created hereunder shall be <br />reduced to writing and shall be signed by both parties. Grantor and Grantee <br />shall have the right to reasonably modify the exact location of the easement area <br />on the Burdened Property, from time to time, as long as the easement area is <br />sufficient for Grantee to reasonably access and use the Truck Scale. The parties <br />may, from time to time, mutually depict or more particularly describe the <br />easement area on the Burdened Property. <br />3. Binding Effect. This Easement shall be permanent and shall be <br />appurtenant to and run with the Burdened Property and the Benefitted Property. <br />The grant of this Easement shall also be binding upon the heirs, executors, <br />administrators, successors and assigns of Grantor and Grantee. <br />4. Liability. The sole rights granted herein are the rights to use the <br />Burdened Property for the purposes described herein, and each parry shall be <br />liable to the other party for any damage caused by the use of the Burdened <br />Property by them or their employees, invitees, agents, successors or assigns, <br />contrary to the terms of this Easement. There shall be no liability on Grantee, its <br />successors and assigns and persons occupying or lawfully present on the <br />Burdened Property for damage, if any, which may be caused by normal and <br />reasonable use of the Burdened Property by vehicular traffic using the truck <br />scale. <br />5. Termination. This Easement shall not be released, terminated, <br />revoked, amended, or modified in any manner, without written consent of the <br />parties. Any puzported release, termination, revocation, amendment, or <br />modification without such written consent shall be null and void and of no force <br />and effect. <br />6. Other Agreements. This Easement shall constitute the entire <br />easement and agreement between the owners of the Burdened Property and the <br />Benefitted Property with respect to the subject matter hereof. <br />7. �rther Assuraaces. Each undersigned party will, whenever it <br />shall be reasonably requested to do so by the other, promptly execute, <br />acknowledge, and deliver, or cause to be executed, acknowledged, or delivered, <br />any and all such further conveyances, confirmations, instruments, or further <br />assurances and consents as may be necessary or proper, in order to effectuate <br />the covenants and agreements herein provided. Each of the undersigned parties <br />shall cooperate in good faith with the other and shall do any and all other acts <br />and execute, acknowledge and deliver any and all documents so requested in <br />order to satisfy the conditions set forth herein and carry out the intent and <br />purposes of this Easement. <br />2 of 5 <br />
