20120636ti <br />4. Grantor's Acknowledgment R�ardin� Removal of Soil. Grantor acknowledge <br />that all excess soils are being removed and placed at the location specified by Grantor as part of <br />Grantee's consideration to Grantor for this Easement and that Grantor is not to receive any other <br />compensation from Grantee for the soil removal. <br />5. Permitted Uses for Temporary Easements. The Temporary Construction <br />Easement may be utilized by the Grantee, its agents, employees, licensees, contractors, <br />subcontractors and their employees, for the purposes of ingress, egress, construction equipment <br />operation and to otherwise facilitate construction in respect to the floodway. <br />6. Termination of Temporarv Easements. The Temporary Construction Easement <br />shall terminate upon the completion of the above-referenced construction of the floodway control <br />dam and related structures for flood control and acceptance of the project as completed by <br />Grantor and Grantee. <br />7. Indemnification. Grantee, its heirs, successors and assigns, shall indemnify and <br />hold grantor, its heirs, successors and assigns, harmless from any liability in respect to the injury <br />of any person while using such easement with the pernussion or at the direction of the Grantee, <br />its heirs, successors and assigns. <br />8. Binding Effect. This Easement and Temporary Construction Easement <br />Agreement shall be binding upon, and shall inure to the benefit of, the parties hereto, and heirs, <br />legal representatives, successors and assigns. <br />IN WITNESS WHEREOF, the undersigned have executed this Construction Easement <br />Agreement on the date first above. <br />���� <br />Wauneta M.
