201206361 <br />1. Conveyance of Easements. For and in consideration of Four Thousand Nine <br />Hundred Twenty-Eight Dollars and NO/100 ($4,928.00) and other good and valuable <br />consideration, the Grantor hereby grants and conveys unto the Grantee, its successors and <br />assigns, the Permanent Flood Easement upon those parcels of real estate as described in the <br />recitals above. <br />2. Obli�ations of Grantee. Grantee, its heirs, successors and assigns, shall ensure <br />that ail spoil areas axe covered with topsoil, seeded and mulched; and ensure that the noxious <br />weeds and tree growth are sprayed on an annual basis, with the unaerstanding that routine <br />maintenance may be perforrned by Grantee or its co-sponsors, the City of Grand Island and Hall <br />County. <br />3. Indemnification. Grantee, its heirs, successors and assigns, shall indemnify and <br />hold grantor, its heirs, successors and assigns, harmless from any liability in respect to the injury <br />of any person while using such easement witk the permission or at the direction of the Grantee, <br />its heirs, successors and assigns. <br />4. Bindin Effect.
