<br />EASEMENT AGREEMENT
<br />This Easement Agreement made and executed this a �' day of July, 2012, by and
<br />between Norman R. Krolikowski and Sandra M. Krolikowski f/k/a Sandra M. Jorgensen,
<br />Husband and Wife, hereinafter referred to as "Grantor", and CENTRAL PLATTE NATURAL
<br />RESOURCES DISTRICT, a Nebraska body corporate and politic, hereinafter referred to as
<br />"Grantee".
<br />WITNESSETH:
<br />WHEREAS, Grantor is the owner in fee simple of that real estate generally described as:
<br />Lot One(1), Mieth Second Subdivision, Hall County, Nebraska
<br />WHEREAS, Grantee seeks to obtain a permanent easement for construction,
<br />maintenance, repair, and operation of floodway control dam and related structures over and upon
<br />that real estate described as:
<br />A parcel of land located in Lot One (1), Mieth Second Subdivision in the
<br />Northeast Quarter of Section Twenty-Seven (27), Township Twelve (12) North,
<br />Range Twelve (12) West of the 6�' P.M., Hall County, Nebraska, being described
<br />as follows: Beginning at the Northwest corner of Lot 1, Mieth 2 Subdivision;
<br />thence N76°13'S2"E (assumed beaxing) on the North line of said Lot 1, a distance
<br />of 154.69 feet; thence S51°20'00"E on said North line, a distance of 41.25 feet;
<br />thence S45°06'07"E, a distance of 72.90 feet; thence S35°16'45"E, a distance of
<br />67.61 feet; thence S16°00'47"E, a distance of 43.50 feet; thence S46°07'36"E, a
<br />distance of 76.80 feet; thence S07°37'41"W, a distance of 22.53 feet; thence
<br />S68°43' 15"W, a distance of 71.35 feet; thence SO4°40'36"W, a distance of 98.19
<br />feet; thence S70°27'46"W, a distance of 39.86 feet; thence S78°46'39"W, a
<br />distance of 80.68 feet; thence S87°22'31"W, a distance of 70.43 feet; thence
<br />N80°20'30"W, a distance of 58.59 feet; thence N60°16'46"W, a distance of 15.62
<br />feet to the West line of said Lot 1; thence N00°47' 19"W on said West line, a
<br />distance of 351.62 feet to the point of beginning, containing 2.33 acres, more or
<br />less;
<br />hereinafter referred to as the "Permanent Flood Easement" as depicted on E�iibit "A" hereto;
<br />and,
<br />WHEREAS, Grantor is willing to grant such Permanent Flood Easement to the Grantee,
<br />its successors and assigns for the purposes of constructing, maintaining, repairing, operating,
<br />patrolling, and replacing a flood control dam and related structures to be situated in the bounds
<br />of the Permanent Flood Easement, subject to the condition that all obligations herein required are
<br />performed;
<br />THEREFORE, in consideration of the mutual covenants contained herein, it is agreed:
