20�20�300 <br />If the Loan is subject to a law which sets maximum loan chazges, and that law is finally interpretefl so t�at <br />tha interest or other loan charges collect� or to be collected in crnmection with the Loan exc�ed the <br />permitted limits, than: (a) any such loan charga shall be reducefl by the amount nacessary to reduce tha <br />chazge to the germitted limit; and (b) any simos alre,�y collected from Borrower wlrich exceaded peimitted <br />limits will be refimded to Borrower. Lender may choose to make this refund by reducing the principal owed <br />under the Note or by malQng a direct payment to Borrower. If a refund reduces principal, tha reduckion will <br />be tr� as a partial prepayment without any prepayment charge (whether or not a prepayment charge is <br />provided for under the Note). Borrow�'s acceptaace of any such refund m�e by direct payment to <br />Borrower will constitute a waiver of any right of action Borrower might have arising out of such overcharge. <br />15. Notic�. All notices given by Bonower or Len�er in connection with ttus Security Instrument must be in <br />writing. Any notice to Borrower in connection with tlus Security Instr�m,ent shall be d� to have b�n <br />given to Horrower when mailed by first class mail ar when actually delivered to Bonower' s notice address <br />if sent by other �ans. Notice to any one Borrower shall constitute notice to all Borrowers unle.ss <br />Applicable Law expressly requires othervvise. The notice ad�ess sha11 be the Property Address unless <br />Boaower has designated a substitute notice address by notice to Lender. Borrower shall pramptly notify <br />Lender of Borrower' s changa of �ckess. If Lender specifies a procedure for reporting Bonower' s change <br />of address, then Borrower sha11 only report a change of address through that specified proceiiure. <br />There may be only one designated notice address under this Security Instrument at aay one time. Any notice <br />to Lender shall be given by delivering it or by mailing it by first class mail to Lender' s address stated herein <br />unless Lender hes designated another �dress by notice to Bonower. Any notice in connaction with this <br />Security Instru�nt sha11 not be deemed to have been given to Lender until actually received by I.ender. If <br />any notice required by this Security Instrum�ent is also required under Applicable Law, the Applicable Law <br />requirement will satisfy the corresponding requirement under this Security Inshvment. <br />16. C�veming Law; Severability; I�les of Construc.tion. Tlris Security Instru�nt shall be governed by <br />federal law and the law of the jurisdiction in which the Property is located All rights and obligations <br />contained in tlus Security �nstrument aze subject to any re,quirements and limitations of Applicable Law. <br />Applicable Law might explicitly or implicitly allow the pazti� to agr� by contract or it might ba silent, but <br />such silence shall not be consbruad as a prolubition against agreement by contract. In the event that any <br />provision or clause of this Security Instrument or the Note conflicts with Applicable Law, such conflict shall <br />not affe�t other provisions of this Security Instr�ment or the Note wluch can ba given effect without the <br />conflicting provision. <br />As used in this Sacurity Instrumen� (a) words of the masculine gender sha11 mean and include corresponding <br />neuter words or words of the feminine gender; (b) words in tha singular shall mean and include the plural <br />and vice versa; and (c) the word "may" gives sole disaretion without any obligation to take any action. <br />17. Bomower's Copy. Borrower shall he given one copy of the Note and of this Security Instrument. <br />18. Transfer of the Property or a Beneficial Iriter� in Borrower.
