<br /> �FINIT�,QNS
<br /> As used hereinafter in this R�A, the foQowing terms shall have tha following
<br />=� respective meanings:
<br />`'��� A. COMMOid AREA The term "Camman Arca" refers to and means all of
<br />``:;� ; the service drives, parking areas, driveways, streets, curbs now or hereafter located on the
<br /> � Site, and intended for th�common use of Occupants and Permittaes of the Site. The term
<br />;� "Common Area"shall not include the Menard outside lumberlsalo area. --
<br />.� B, EFFECTIVE DATE. The term "Effactive Date" refers to and means the
<br /> date that this REA shall become effecrive, v�+hich date shall be the day that this ItEA is
<br />'� recorded in Hall County,Nebraska.
<br /> C. OCCUPANT. The term"Occupant" refers to any Person&Am time to time
<br /> entitled to the use and occupancy of all or a portion of any building or common area on the
<br /> Site under any le�se,deed, or other instniment or arrangement whereunder such Person has

<br />�-- parking area or common area.
<br /> D, PARTY OR PARTIES. The term "Party" or "Parties" refers to tho
<br /> respective owners Gom time to time af the Menard,Clear erd JRM Parcels.
<br /> � E. PERMI'TTEES. The term "Perrnittees" refers to all Occupants and their
<br />'� .. respective offiicers. directors,pattnare, employees,agents, contractors, customers,visitors,
<br /> � invitees,licensees,subtenants and concossionaires.
<br /> � F. PER5AN. The word "�erson" refers to snd shall include individusls,
<br /> partnerships,fums,associations snd corporations,or any othtr foim of business and the use
<br /> of the singular shall include the plural.
<br /> G. STORE OR STORES. The term "Store" or "Stores" rsfers to the
<br /> building(s), respectivdy, housing the Menard Stores and/or any other retail stores
<br />--- conatructed by Parties on any Parcels,if any,as the�ontext may appropriately require.
<br /> ARTICLF II
<br /> EASE�VIEI�CTS
<br /> -= A. NONEXCLUSIVE EASEMENTS FOR INGRESS AND EGRECS AND
<br /> — INCIDENT'AL USES. The Parties for themselves and on behalf of any fiature Parties -
<br /> ::_� hereto hereby grant and quit claim to each of the other Parties, for their respective use,and
<br /> � for the use of their respective Permittees, in common with all others entitled to use the
<br /> ::� same, mutual, reciprocal and non-exclusive easements over the Common Areas of each
<br /> �� Parcel,for ingress into and egress from such respective Parcel, for the passage and parking
