<br />2. TAXES. Trustor shall pay each insta.11ment of all taxes and special assessments of every kind, now
<br />or hereafter levied against the Trust Estate ox any part thereof, before delinquency, without notice ox
<br />dema.nd, and shall provide Beneficiary with evidence of the payment of same. Trustox shall pay all taxes
<br />and assessments which may be levied upon Beneficiary's interest heYein or upon tliis Deed of Trust ox
<br />the debt secuted hereby, without regatd to any law that may be enacted imposing payment of the whole
<br />or any part thexeof upon the Beneficiary.
<br />3. INSURANCE AND REPAIRS. Trustor shall maintain fixe and extended covexage insurance
<br />insuxing the improvements and buildings constituting part of the Trust Esta,te for an amount no less
<br />than the amount of the unpaid principal balance of the Note (Co-insuxance not exceeding 80%
<br />permitted). Such insi:�ance policy shall contai.n a standard mortgage cla.use in favox of Beneficiary and
<br />shall not be cancelable, termivable ox modifia.ble without ten (10) days priox wxitten notice to
<br />Beneficiary, Trustor shall pxomptly repaix, maintain, and xepla.ce the Trust Estate or any part thereof so
<br />that, except for oxdinary wear and tea.t, the Trust Esta.te shall not deterioxate. In no event shall the
<br />Trustor commit waste on or to the Trust Estate.
<br />4. ACTIONS AFFECTING TRUST ESTATE. Trustox shall appear in and contest anp action or
<br />pYOCeeding purporting to affect the secus-ity hereof or the rights or powers of Beneficiary or Trustee,
<br />and shall pay all costs and expenses, including cost of evidence of tide and attomey's fees, in anp such
<br />action ox proceeding in which Beneficiary ox Trustee ma,y appear. Should Trustox fail to make any
<br />payment ox to do any act as and in the ma.nner provided in any of the Loan Instruments, Beneficiary
<br />and/or Trustee, each in its own discretion, without obligation so to do and without notice to or deman d
<br />upon Trustox and without xeleasing Trustor from any obligation, ma,p make or do the same in such
<br />mannex and to such extent as either map deem necessaxy to protect the security hereof. Trustox shall,
<br />immedia,tely upon demand therefor by Beneficiary, pay all costs and expenses incurted by Beneficiary
<br />in connection with the exercise by beneficiary of the foregoing rights, including without limita,tion costs
<br />of evidence of tide, couxt costs, appxaisals, surveys and attomey's fees. Any such costs and expenses
<br />not paid within ten (10) da.ys of writtett demand shall dxaw interest at the default Yate pYOVided in the
<br />Note.
<br />5. EMINENT DOMAIN. Should the Trust Estate, or any part theYeof or interest thexein, be taken
<br />or da.maged by xeason of any public improvement or condemnation pxoceeding, or in anp other manner
<br />including deed in lieu of Condemnation ("Condemnation"), or should Trustox xeceive any notice or
<br />other information regarding such pxoceeding, Trustor shall give prompt written notice thereof to
<br />Beneficiary. Beneficia.ry shall be entitled to all compensation, awards and othex payments or xelief
<br />theYefor, and shall be entided at its option to commence, appear in and prosecute in its own name any
<br />action or proceedings. Beneficiary shall also be entided to make any compromise oY settlement in
<br />connection with such taking or dama.ge. All such compensation, awaxds, damages, rights of action and
<br />proceeds awaxded to Trustor (the "Proceeds") axe herebp assigned to Beneficiary and Tnxstox agtees to
<br />execute such further assignments of the Pxoceeds as Beneficiary or Trust ma,y require.
<br />6. FLTTURE ADVANCES. Upon Yequest of Trustor, Beneficiary, at Beneficiary's option, priox to
<br />reconveyance of the Property to Trustor, may ma.ke future advances to Trustor. Such future advances,
<br />with interest thexeon, shall be secuxed by this Deed of Trust when evidenced by promissory notes
<br />stating that said notes axe secuxed hereby.
<br />7. APPOINTMENT OF SUCCESSOR TRUSTEE. Beneficiary ma,y, from time to time, by written
<br />insmxment executed and acknowledged bp Beneficiary, ma.iled to Trustor and Recorded in the County
