201205563 <br />Should it become necessary for the appointment of a guardian for any minor child <br />of mine, or for the appointment of a conservator for the estate of any minor child of mine, or for <br />the appointment of a successor custodian for any property held by me as custodian for a child of <br />mine under the Nebraska Uniform Gifts to Minors Act, or the Nebraska Uniform Transfers to <br />Minors Act, or any similar act, I hereby nominate my attorney as such guardian, conservator <br />and/or successor custodian. <br />26. Ratification and Declaration in Favor of Persons Without Notice of <br />Revocation. I hereby promise at all times to ratify and confirm a11 that my attorney shall lawfully <br />do or cause to be done hereunder, including anything which shall be done between the revocation <br />of this document by my death or in any other manner and notice of such revocation reaching my <br />attorney. I hereby declare that, as against me and all persons claiming under me, everything <br />which my attorney shall do or cause to be done in pursuance hereof shall be valid and effectual in <br />favor of any person claiming the benefit thereof who, before the doing thereof, shall not have had <br />notice of such revocation. <br />27. Power of Attorney Effective Notwithstanding Disability of Principal; <br />Continues in Effect After Principal's Death Until Notice. Pursuant to the provisions of Nebraska <br />Probate Code Section 30-2665, I declare that this power of attorney shall not be effected by my <br />subsequent disability or incapacity and that the authority granted herein shall continue during any <br />period while I am disabled or incapacitated. Further, pursuant to Section 30-2668, all such <br />authority shall continue after my death until notice of my death shall have been received by my <br />attorney so that my attorney has actual knowledge of the fact that I have died. Any action taken <br />in good faith by said attorney during any period while it is uncertain whether I am alive, before <br />my attorney receives actual knowledge of my death or, in any event, taken during any period <br />while I am disabled or incapacitated, shall be as valid as if I were alive, competent and not <br />disabled. <br />28. Revocation of Prior Powers. I revoke all prior Durable or general Powers <br />of Attorney that I may have executed and I retain the right to revoke this Power. <br />29. Revocation of this Power. This Power can be revoked only in the <br />following manner: <br />(a) By the execution by me of a subsequent Durable Power of <br />Attorney, unless the subsequent Power contains a statement to the contrary and <br />specifically refers to this Power by its date; or <br />(b) By recordation of my express written revocation in the office of the <br />County Clerk of the county of my residence or domicile or in any county in any <br />state in which this Power has been recorded; or <br />(c) By the lawful revocation by the conservator of my estate. <br />5 .c6lL��L <br />
