20120531� <br />7 5. Borrowers Copy. Borrower shall be given one confornned copy of the Note and of this Security <br />Instrument. <br />16. Hazar9dous Substances. Borrower shall not cause or permit the presence, use, disposal, storage, or release <br />of any Hazardous Substances on or in the Properiy. Borrower shall not do, nor allow anyone else to do, <br />anything affecUng the Properly that is in violation of any Environmental Law. The preceding two sentences <br />sha11 not apply to the presence, use, or storage on the Property of small quantities of Hazardous Substances <br />that are generally recognized to be appropriate to normal residential uses and to maintenence of the Property. <br />Borrower shall promptly give Lender written notice of any investigation, claim, demand, lawsuit or other <br />acrion by any governmental or regulatorY agency or private party involving the Property and any Hazardous <br />Substancx or Environ�ntal Law of wluch Bortower has actual knowledge. If Borrower le�ns, or is notifie� <br />bY anY govern�ntal or regulatory authority, that any removal or other remadiation of any Ha�rdous <br />Substances affecting the PruPert3' is n�essary, Borrower shall PromPtlY take all necessazy remedial actions <br />in accordanc� with Environmental Law. <br />As used in this paragraph 16, °Ha�dous Substances" aze thosa substances defined as toxic or ha�rdous <br />substancesbyEnvironmentalLa.wandthefollowing substances: gasoline, kerosene, other flammable ortoxic <br />petaoleumproducts, toxicpesticides andherbicides, volatile solvents, materials containing asbe�tos or <br />formaldehyde, andradioactivematerials. AsusedintUisparagraph 16, "Environn�entalLaw" meansfederal <br />laws andlaws oftha jurisdictionwheretheProperty is lacatedthatrelatetohealth, safety or environmental <br />protection. <br />Non-Uniform Covenants. Borrower and Lender further covenant and agree as follows: <br />17. Assignment of Rsrrts. Bonower unconditionally assigns and transfers to Lender all the rents and revenues <br />of the Properiy. Horrower authorizes Lender or Lender's agents to collect tha rents and revenues and hereby <br />directa each tenant of the Properiy to pay the rents to Lender or I,ender's agents. However, prior to Lender's <br />notice to Borrower of Borrower' s breach of any covenant or agreement in the Sacurity Instrument, Boaower <br />shall collect and r�eive all rents and revenu� of the Property as tivstee for the benefit of Lender and <br />Borrower. This assignment of rents constit�rtes an absolute assignment and not an assignment for additional <br />security only. <br />If Lender gives notice of breach to Bonower: (a) all rents received by Bonower shall be held by Borrower <br />as trustee for benefit of I,ender only, to be applied to the sums secured by the S�urity Instru�nt; (b) <br />Lender shall be entitled to colle�ct and receive all of the rents of the Properly; and (c) each tenant of tha <br />Property ahall pay all ren� due and unpaid to I.ender or Lender' s agent on I.ander' s written demaad to the <br />tenant. <br />Borrower has not executed any prior assignment of the renta snd has not and will not perform aay act that <br />would prevent Lander from exercising its rights under this paragraph 17. <br />I.ender shall not be required to enter upon, take control of or maintain the Praperly befora or after giving <br />notice of breach to Bonower. However, Lender or a judicially appointed re�eiver may do so at any tima <br />there is a breach. Any application of rents shall not cure or waive any default or invalidate sny other right or <br />remedy of Le�der. This assignment of rents of tha Properiy shall terminate when the debt secured by tha <br />Security Inslrument is paid in full. <br />18. Foreclosure Prott�d�uroe. If Lender reqnires imm�iate payment in fnll ander paragraph 9, Lender <br />may invoke the power of sale and any other remedies germitte�i by applicable law.
