<br />21. Haz�rdo� Substant�s. As used in this Secnon 21: (a) "Hazardous Substances" are those substauce.s
<br />defined as toxic or ha�ardous substances, pollutants, or wastes by Environmentsl I,aw and the following
<br />substances: gasoline, kerosene, other fiammable or toxic p�tnoteurn products, toxic pesticides and herbicides,
<br />voiatile solvents pnaterials vontaiuing asbestos or fom�aldehyde, and radioactive �terials; (b)
<br />"Bnvironmental Law" means f�eral laws and laws of the�unsdiction where the Property is lo� that
<br />rela#e to health, safety or envimnmentai prote�tion; (c) "Envrronmental Cleanup" includes any r�ponse
<br />action, remediat action, or removal action, as defined ia Environrnental Law; and (� an "Env�ronmenta!
<br />Cond3Eion" meanS a Condition tttat can Cause caniribute to, or otherwise Ixigger an Environmental Cleanup.
<br />Baaower shall not cause or permit the presence, use, disposal, stvrage. or release of any Ha�rdous
<br />Substances, or Wreaten to release any Ha�ardous Substancss, on or in the Properiy. Boaower shall not do,
<br />nor allow anyone else to do, anything affecting the Progerty (a) that is in violation of aay Environmental
<br />I.aw, (b) wbich creates an Environt�ntal Condition, or {c) which, ciue to the presence, use, or release of a
<br />Ha�rdous Substarn;e, creates a cond'trion that adversely aff�ts the value of the Property. The prece�ing two
<br />se�ntences shal) cwt apply to ttia presence, usa, or storage on the Property of small quantities of Hazardous
<br />Substances that aze generally r�ognized W be appropriate to normal rasidential uses and to maintenance of
<br />the Property (including, but not limited to, bar.araous substa�►cas in consumer products).
<br />B�rrower shall prompUy give Lr�der written notice of (a) any invesbgation, cisim, dsmand, lawsuit or other
<br />action by any governmental or reguiatory agency or private party invoiving the Property and any Ha�rdous
<br />Substance or Environmental Law of wlvch Borrower has actual knowledge, (b) any Environmental
<br />Condition, mctuding but not limited to, any apilliag, leaking, di�harge, relea� or threat of release of any
<br />Ha�rdous Substance, and (c) any c�ondition caused by� ti�e pre�nce, use or reiease of a Ha�ardons Substance
<br />wluch adveiseiy aff�ts the vaiue of the Proporiy. If Borrower lear�, or is noti5ed by any govemmental or
<br />regWatory authority, or any private party, that any removal or other remediation of any Hazardous Substacice
<br />affectmg the Property is nec�sary, Borrower sliall promptly take all necessary remedial actions in
<br />acxordance with Environmenta! Law. Nothing heiein sFiall cr�te any obligahon on Lender for en
<br />Environmental Cleanup.
<br />Non-Unifarm Covenants. Borrower and Lender covenant and agra as follows:
<br />22. Actaeleration; Remedies. Lender shall give sotice to Borrower prior to acceleration following
<br />Borrower°s breach of any covensnt or agreement in tdis Security Instrument (but not prior to
<br />acceleraHoa under Sertioa 18 unleas Applicable Law provides otherwise� The natice shall specify: (a)
<br />the default; (b) tde actlon re�uired W cure the defanit; (c) a date, not less than 30 days from the date
<br />t�e aotlee Is given to Borrower, by which the defanit must be cured; and {d) that failure to cure the
<br />default on or before the date specifi�l ia the notice may resnit in acceleration of t6e sums e�ared by
<br />this Security Instrument and sale ai the Property. The notics shall further inform Borrower of the
<br />right to reinstate after aczelerstion and the right to briag a caurt action to assert the non-existence of a
<br />default or any other defense of Borrower to acceleratlon �nd sale. If the default is nor cure.d on ar
<br />before the date speciSed ln the notice, Lender at its opt#on may require immedfate payment in full of
<br />all sums secured by this Security Instrnareat withoat further demand and may invoke the power of sale
<br />and any ot1►er rem+edies permitted by Applicable Law. Lender shall be entitled to collect all eapenses
<br />incurred in pursuing the remediea provIIded in t6is Secblon 22, inclading, but not fimited to, ressonable
<br />attorneys� fe� and costs of tltle evidence.
