<br />Edward E. Brink, was appointed successor trustee pursuant to an Appointment of Successor Trustee
<br />which was recorded on January 9, 2012, as Document No. 201200186 in the records of the Register of
<br />Deeds of Hall County, Nebraska.
<br />Edward E. Brink, Successor Trustee, referred to as Grantor, in consideration of $54,000.00 and
<br />other valuable consideration received from Welis Fargo Bank, National Association, as Trustee under
<br />Pooling and Servicing Agreement dated as of September 1, 2004 Asset-Backed Pass-Through
<br />Certificates, Series 2004-WHQ1, , Beneficiary, does grant, bargain, sell, convey and confirm unto.Welis
<br />Fargo Bank, National Association, as Trustee under Pooling and Servicing Agreement dated as of
<br />September 1, 2004 Asset-Backed Pass-Through Certificates, Series 2004-WHQ1, the following described
<br />real property in Hall County, Nebraska:
<br />The West One-third (W 1/3) of Lots Five (5) and Six {6) in Block Seven (7) in HANN'S
<br />THIRD ADDITION to the City of Grand Island, Hall County, Nebraska, being a rectangular
<br />tract of ground having a South frontage of Fifty-three (53) feet and Eight (8) inches on
<br />Charles Street in said city, and a depth of One Hundred and Six (106) feet; together with a
<br />right-of-way easement over and across the North Ten (10) feet of the West One-third (W
<br />1/3) of said Lot Five (5) for driveway purposes
<br />commonly known as 218 East Charles Street, Grand Island, NE 68801.
<br />To have and to hold the above-described premises together with all tenements, hereditaments
<br />and appurtenances belonging unto Wells Fargo Bank, National Assaciation, as Trustee under Pooling
<br />and Servicing Agreement dated as of September 1, 2004 Asset-Backed Pass-Through Certificates,
<br />Series 2004 WHQ1, forever.
<br />GRANTOR makes the following covenants with Wells Fargo Bank, National Association, as
<br />Tn,istee under Pooling and Servicing Agreement dated as of September 1, 2004 Asset-Backed Pass-
<br />Through Certificates, Series 2004-WHQ1:
<br />1. David A. Vargas, as Trustor(s), failed to pay the Beneficiary payments which were contractually
<br />due, and the Grantor, at the request of the Beneficiary, elected to declare the entire unpaid
<br />principal balance, together with interest at once immediately due and payable.
<br />2. A Notice of Default was recorded by Grantor on January 9, 2012, in the records of the Register of
<br />Deeds of Hall County, Nebraska, as Instrument 201200187. Within 10 days thereafter, a copy of
<br />the recorded Notice of Default was mailed by certified mail, postage prepaid, to all parties entitled
<br />to notice, pursuant to the Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008
<br />(Reissue 2003).
<br />3. David A. Vargas failed to cure the default referenced in the Notice of Default within thirty (30)
<br />days after recording of the Notice of Default.
<br />4. A Notice of Trustee's Sale was executed by Grantor. At least 20 days prior to the scheduled date
<br />of sale, a copy of the Notice of time and place of the Trustee's Sale was mailed by certified mail,
<br />postage prepaid, to all parties entitled to notice, pursuant to the Deed of Trust and in compliance
<br />with Neb. Rev. Stat. §76-1008 (Reissue 2003).
<br />5. Grantor published the Notice of Trustee's Sale, which was held on March 20, 2012 at 10:00 AM,
<br />at the of the Hall County Courthouse, Grand Island, Hall County, Nebraska, which Notice was
<br />published in Grand Island Independent, once a week for 5 consecutive weeks, commencing on
<br />February 9, 2012. The last publication was at least 10 days prior to the scheduled Trustee's Sale
<br />File No. 114064
