<br />KNOW ALL MEN BY THESE PRESENTS that THOMAS LOCHER, is the Trustee
<br />under a Deed of Trust made and entered into on or about November 24, 2009, by and between JEB
<br />S. WOL5LEBEN, (unmarried), Trustor, and THOMAS M. LOCHER, Trustee, MORTGAGE
<br />ELECTRONIC REGISTRATION SYSTEMS, INC., Beneficiary. Said Deed of Trust was
<br />recorded on December 7, 2009 as Instrument No. 2009-09603 of the Mortgage Records of Hall
<br />County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment dated
<br />January 26, 2011 to U.S. BANK NATIONAL ASSOCIATION, and which was filed for record on
<br />February 23, 2011, as Instrument No. 2011-01446 of the Mortgage Records of Hall County,
<br />Nebraska. THOMAS LOCHER, Grantor, in consideration of the sum of Eighty-Eight Thousand
<br />5even Hundred Thirty-Six and 32/100 Dollars ($88,736.32) and other good and valuable
<br />consideration received from U.S. BANK NATIONAL ASSOCIATION, does hereby grant,
<br />bargain, sell, convey and confirm unto U.S. BANK NATIONAL ASSOCIATION, (hereinafter
<br />"Grantee" where appropriate), the following-described real property in Hall County, Nebraska, to
<br />wit:
<br />Lot 2, Cooper Subdivision, in the City of Grand Island, Hall County,
<br />Nebraska.
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />1. That JEB S. WOLSLEBEN, as Trustor, failed to pay to Beneficiary payments which were
<br />contractually due, and the Grantor, at the request of the Beneficiary, elected to declare the
<br />entire unpaid principal balance, together with interest thereon at once immediately due and
<br />payable.
<br />2. That Jeb S. Wolsleben filed his Chapter 13 Bankruptcy Petition on Apri120, 2011 and U.S.
<br />Bank National Association obtained relief from the Ba.nkruptcy Stay on December 23, 2011.
<br />A copy of said Order is attached hereto and marked as E�iibit "A".
<br />That a Notice of Default as required by § 76-1006 was filed by Grantor on February 24,
<br />2011, as Instrument No. 2011-01492 in the Office of the Register of Deeds of Hall County,
<br />Nebraska. A copy of said Notice of Default was thereafter mailed to all parties entitled to
<br />notice, pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebra.ska.
<br />4. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />5. That a Notice of Trustee's Sale was filed by Grantor on February 21, 2012, as Instrument No.
<br />2012-01311 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said
<br />Notice of the time and place of the sale was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska.
