20�200291 <br />terminate this Agreement (including without limita.tion the right to use the Sewer System) in the <br />event that the Property is able to connect to the City of Grand Island sewer system at any time <br />after the date of this Agreement by providing written notice to PSK in which event this <br />Agreement shall terminate on the date such notice is provided to PSK. <br />b. PSK shall pay Highway Motels a monthly fee of Two Hundred Fifty <br />Dollazs ($250.00) payable in advance, for the right to use the Sewer System. <br />c. PSK shall be responsible, at its sole cost and expense for the maintenance <br />of any portion of the Sewer System actually located on the PSK Property and for the piping that <br />it uses to connect to the Sewer System located on or under the Highway Motels Property. <br />d. PSK shall pay 30% of the cost to maintain, repair, replace and service the <br />Sewer 5ystem, provided that prior to being required to pay such amounts, PSK shall have the <br />right to review and approve any charges related to the Sewer System; and, provided, further, that <br />during the first 10 years after the date of this Agreement, Purchaser's obligations under this <br />Section 1(d) shall not exceed $3,500.00. <br />2. Binding Effect; Assignment and Amendment. These covenants, rights and <br />obligations sha11 run with the Property and shall be binding upon and enforceable by PSK or <br />Highway Motels and their respective heirs, personal representa.tives, successors and assigns. <br />Transfer of ownership of any portion of the Property shall constitute an assignment of the <br />covenants, rights and obligations related to that portion of the Property transferred. This <br />Agreement may be amended only by the written agreement of the owners of the PSK Property <br />and Highway Motels Property and their respective heirs, personal representatives, successors and <br />assigns. <br />3. Effective Date of Amendment. Any instrument amending, modifying, abrogating <br />or canceling this Agreement must be recorded before it shall be effective. <br />4. Counterparts. T'his Agreement may be executed in two or more counterparts, <br />each of which shall be deemed an original, but all of which together shall constitute one and the <br />same instrument. An electronic transmission or facsimile of this Agxeement shall be deemed an <br />original and shall be admissible as evidence of the document and the signer's execution. <br />jThe remainder of this page intentionally left blank; signature page follows] <br />
