The Property, other than the PSK <br />Property, shall be referred to herein as the "Highway Motels Property"; and <br />WHEREAS, as a term and condition of the Purchase Agreement Highway Motels and <br />PRK have entered into this Agreement to provide each parly with certain rights and obligations <br />that impact the Property and the PSK Property that will run with the land. <br />NOW THEREFORE, Highway Motels and PSK mutually agree to the following <br />covenants, obligations and restrictions against and upon the Property: <br />1. Sewer S, stem. There is currently a sewer system, equipment, <br />improvements and connecting piping system maintained for the use of the Property (the "Sewer <br />System"). PSK shall have the right to continue to use the Sewer System and the parties shall <br />have the following rights and obligations with respect to the Sewer System: <br />a. PSK shall have the perpetual right to use the Sewer System; provided, <br />however, that Highway Motels sha11 have the right, in its sole and absolute discretion, to <br />
