<br />t=' 20000260 <br /> <br />hereinafter referred to as the "Property," be hereby approved SUBJECT TO the following <br />restrictions which shall be recorded against the Property contemporaneously with the recording <br />of the plat in the office of the Hall County Register of Deeds, to wit: <br /> <br />1. The Property shall consist of a single lot of 1.19 acre lot more or less with a historic dwelling <br />to be used as a single-family residence, museum, recreational facility or offices of a non- <br />profit entity as laid out in The Planned Unit Development Plan approved by the Hall County <br />Board of Supervisors. <br /> <br />2. Outbuildings erected 011 the Property shall be consistent and appropriate in nature and <br />architectural character and design of the period of the late 19th Century. Outbuildings shall <br />consist of appurtenant buildings such as an ice-house, barn, and well house and constructed <br />in phases as set forth in the approved development plan. <br /> <br />3. There shall be no outside storage of junk cars, rubbish, machinery or other unsightly <br />materials on the Property. <br /> <br />4. All Hall County resolutions and building codes shall be followed in the restoration, <br />renovation, or modification of the historic dwelling and in the construction, erection, <br />restoration, ren~)Vation or modification of any appurtenant building or structure placed upon <br />the Property. <br /> <br />5. Any well or septic system shall comply fully with the rules and regulations of the Nebraska <br />Department of Health and Human Services. <br /> <br />6. Public and visitors parking, if any, shall be north or northerly of the historic dwelling as <br />shown in the Planned Unit Development Plan. <br /> <br />7. Landscaping design of the property shall consist of native grasses, wildflowers, shrubs, <br />arboretums, and gardens, consistent with period of the late 19th Century. Any trees shall be <br />of a fruit-bearing orchard type placed according to the Planned Unit Development Plan. <br /> <br />8. Within one (1) year of the date hereof, the Owner shall encumber the property shall by a <br />preservation easement, as provided by the Nebraska Conservation and Preservation Easement <br />Act, Neb.Rev.Stat. 76-2,111 through 76-2,118, as amended. Said preservation easement <br />shall be not less restrictive that the restrictions set forth herein and shall be held by a.) a <br />governmental body empowered to hold an interest in real property in this state under the laws <br />of Nebraska or the United States having among its purposes the subject matter of the <br />easement or b.) by a charitable corporation or trust whose purposes include the preservation <br />of the historical, architectural, archaeological, or cultural aspects of real property. <br /> <br />9. Any outside signage shall be consistent with State Historical Markers in size and appearance. <br /> <br />10. Any changes to the above covenants shall be subject to prior approval of the Hall County <br />Board of Supervisors and such parties having an interest of record in said property. <br /> <br />Page 2 of3 <br />
