<br />F 20000138 <br /> <br />wit: <br /> <br />Lot One (1) on Island and the Southeast Quarter of the Northeast <br />Quarter (SE1I4 NE1I4) all in Section Twenty-four (24) Township Ten (10) <br />North, Range Eleven (11) West of the 6th Prime Meridian, Hall County, <br />Nebraska; <br />Part of the East half of the Southeast Quarter (El/2 SEl/4) of <br />Section Twenty-four (24), Township Ten (10) North, Range Eleven (ll) <br />West of the 6th Prime Meridian, Hall County, Nebraska; and <br />A tract of land located in the Northwest Quarter of the East half of <br />the Southeast Quarter (NWI/4 El/2 SEl/4) and part of the West half of the <br />Northeast Quarter (Wl/2 NE1I4) of Section Twenty-four (24) Township <br />Ten (10) North, Range Eleven (11) West of the 6th Prime Meridian, Hall <br />County, Nebraska; and <br /> <br />WHEREAS, the above-described real estate is located within the AG-l Zoning <br />District; and <br /> <br />WHEREAS, Applicant has presented an application for a Conditional Use Permit to <br />the Hall County Board of Supervisors requesting a Conditional Use Permit for the mining <br />and pumping of sand and gravel from the land; and <br /> <br />WHEREAS, the Hall County Board of Supervisors finds that such use is authorized <br />under the conditional uses within the AG-l District; that such use, as limited herein, will <br />not adversely affect the public interest; and that said Board is empowered under the <br />Zoning Resolution to permit such conditional use. <br /> <br />NOW, THEREFORE, the Hall County Board of Supervisors hereby grants to <br />applicant a Conditional Use Permit to use the above described real estate for the mining <br />and pumping, of sand and gravel from the land SUBJECT TO THE FOLLOWING <br />CONDITIONS, RESTRICTIONS AND LIMITATIONS; <br /> <br />(A) All dead trees, rubbish and debris, if any, must be cleared from the above <br />described real estate as soon as practical and said real estate must, at all times, be kept in <br />a clean and neat condition. <br /> <br />(B) No trash, rubbish, debris, broken concrete, dead trees, lumber, bricks, refuse <br />or junk material of any nature whatsoever shall be dumped, placed or located upon said <br />real estate. <br /> <br />(C) Applicant shall not use said real estate in such a way so as to create or result <br />in an umeasonable hazard to nuisance or nuisance to adjacent landowners or to the <br />general public. <br /> <br />(D) Applicant shall maintain any and all drainage ditches that may be located <br />upon the real property. <br />
