<br />F 20000184 <br /> <br />Stelk made a motion and Jeffries second to close the public hearing for the conditional <br />use permit. Arnold, Hartman, Jeffries, Lancaster, Landis, Logan and Stelk all voted yes <br />and none voted no. Motion carried. <br /> <br />Stelk made a motion and Jeffries seconded to approve Resolution # 00-0024 for the <br />conditional use permit for Emil Schaaf. Arnold, Hartman, Jeffries, Lancaster, Landis, <br />Logan and Stelk all voted yes and none voted no. Motion carried. <br />RESOLUTION #00- 0024 <br /> <br />A RESOLUTION AUTHORIZING THE CONDITIONAL USE OF THE EAST <br />HALF OF THE SOUTHEAST QUARTER (E 1/2 SE 1/4) AND THAT PART <br />OF LOT TWO (2) ON ISLAND SOUTH OF THE HALF SECTION LINE, <br />SECTION TEN (10), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) <br />WEST OF THE 6th P.M., HALL COUNTY, NEBRASKA. <br /> <br />WHEREAS, Emil Schaaf, hereinafter referred to as "applicant," is the owner of <br />the following described real estate, to wit: <br /> <br />The East Half of the South east Quarter (EI/2 SEl/4) and that part of Lot Two (2) on <br />Island south of the half section line, Section Ten (10), Township Ten (10) North, Range <br />Ten (10) West of the 6th P.M., Hall County, Nebraska; and <br /> <br />WHEREAS, the above-described real estate is located within the AG-I Zoning <br />District; and <br /> <br />WHEREAS, Applicant has presented an application for a Conditional Use Permit <br />to the Hall County Board of Supervisors requesting a Conditional Use Permit for the <br />mining and pumping of sand and gravel from the land; and <br /> <br />WHEREAS, the Hall County Board of Supervisors finds that such use is <br />authorized under the conditional uses within the AG-I District; that such use, as limited <br />herein, will not adversely affect the public interest; and that said Board is empowered <br />under the Zoning Resolution to permit such conditional use. <br /> <br />NOW, THEREFORE, the Hall County Board of Supervisors hereby grants to <br />applicant a Conditional Use Permit to use the above described real estate for the mining <br />and pumping of sand and gravel from the land SUBJECT TO THE FOLLOWING <br />CONDITIONS, RESTRICTIONS AND LIMIT A TIONS: <br /> <br />(A) All dead trees, rubbish and debris, if any, must be cleared from the above <br />described real estate as soon as practical and said real estate must, at all times, be kept in <br />a clean and neat condition. <br /> <br />(B) No trash, rubbish, debris, broken concrete, dead trees, lumber, bricks, refuse <br />or junk material of any nature whatsoever shall be dumped, placed or located upon said <br />real estate. <br />
