<br />f01661 <br /> <br />4. Applicant shall pennit the County of Hall or its designee to place an antenna for <br />emergency/local government communications using one of the antenna locations available <br />on the tower as provided for in section 12-23 of the Hall County Zoning Resolution. <br /> <br />5. Applicant shall pennit inspection of the tower by the County of Hall, its employees and <br />agents, for the purpose of detennining the structural integrity of the same. If, based upon any <br />such inspection, it is detennined that the structural integrity of the tower is or may be <br />compromised the County shall provide to applicant written notice of such detennination and <br />shall order the removal of the tower. Within thirty days following receipt of such notice <br />applicant shall dismantle and remove the tower or shall provide the Hall County Building <br />Inspector with a written report of a licensed professional engineer certifying the structural <br />integrity of the tower. <br /> <br />6. Nothing in this grant of conditional use shall be construed as a grant of right, authority or <br />pennit to allow any use of land, materials or methods which violate any state or federal law <br />or rule or regulation of a federal, state or local agency other than as specificilly set forth <br />herein. The applicant shall be required, as a condition of this pennit, to COJJlply with all <br />applicable state and federal laws and regulations including, but not limited to, those <br />pertaining to telecommunications, water quality, surface drainage, flood control and <br />protection, and environmental quality and protection. Applicant shall at all times comply <br />with any and all tower marking and illumination requirements of the Federal Aviation <br />Administration and the Federal Communications Commission. <br /> <br />7. Applicant shall erect, construct, operate, and maintain said microwave telecommunications <br />tower and related structures in accordance with applicant's application for conditional use <br />and in accordance with applicable Hall County Building Codes. <br /> <br />8. Applicant shall dismantle and remove the tower within sixty (60) days following the <br />expiration or tennination of this conditional use pennit. <br /> <br />9. The tenn of this conditional use pennit shall be for a period of five (5) years beginning the <br />date hereof, but may be tenninated if applicant -fails to comply with any of the conditions, <br />restrictions and obligations set forth herein. In the event of noncompliance, the Hall County <br />Board of Supervisors shall notify the applicant in writing setting forth the specific area or <br />areas of noncompliance. If the applicant fails to cure any such noncompliance within 30 <br />days after receiving said notice, the Hall County Board of Supervisors shall hold a hearing to <br />consider the suspension, revocation, or tennination of this pennit of conditional use. <br /> <br />This Conditional Use Pennit is hereby granted this J3. day of November, 2001, subject <br />to the tenns, conditions and restrictions above set forth. <br /> <br /> <br />Resolution moved by Supervisor ~U l'i .Jp ~ f ~ e 5 <br /> <br /> <br />Seconded by Supervisor y\ Y'Y"\ ~\ \ ~ S e Y'\.. <br /> <br />Page 2 of3 <br /> <br />Conditional Use - iPCS Wireless, Inc. <br />
