CONSIDER AND ADOPT RESOLUTION GRANTING CONDITIONAL USE PERMIT <br />FOR IPCS NORTHERN TOWER- The public hearing for this was held October 23 and <br />the board approved the conditional use permit. Jeffries stated that this tower is in the <br />northern part of the county, and the conditional use committee recommended approving <br />it. Jeffries made a motion and Eriksen seconded to approve Resolution #01-0074 for the <br />conditional use permit for IPCS. Arnold, Eriksen, Hartman, Humiston, Jeffries, <br />Lancaster and Logan all voted yes and none voted no. Motion carried. <br /> <br />RESOLUTION # (J \- 00 1-=t- <br /> <br />A RESOLUTION GRANTING THE APPLICATION FOR A CONDITIONAL USE OF A <br />P ART OF THE NORTHWEST QUARTER (NW 1/4) OF SECTION FIVE (5), <br />TOWNSHIP TWELVE (12) NORTH, RANGE NINE (9) WEST OF THE 6th P.M., HALL <br />COUNTY, NEBRASKA. <br /> <br />WHEREAS, iPCS Wireless, Inc., a Delaware corporation, hereinafter referred to as <br />applicant, is the lessee of a tract of land located in the NORTHWEST QUARTER (NW 1/4) OF <br />SECTION FIVE (5), TOWNSHIP TWELVE (12) NORTH, RANGE NINE (9) WEST OF THE <br />6th P.M., HALL COUNTY, NEBRASKA, as more particularly set forth in applicant's site plan <br />and application; and <br /> <br />WHEREAS, applicant has made its written application for a permit to use the above- <br />described property for the erection, operation, and maintenance of a self-supporting <br />telecommunications tower one hundred ninety (190) feet in height; and <br /> <br />~ <br /> <br />.. <br /> <br />WHEREAS, said property is located within the AG-I Agricultural Zoning D1strict; and <br /> <br />WHEREAS, on October 23,2001, a public hearing was held upon said application by the <br />Hall County Board of Supervisors following due and proper notice of the same to the public; and <br /> <br />WHEREAS, the Hall County Board of Supervisors is empowered pursuant to the Hall <br />County Zoning Resolution to grant an application for conditional use upon a determination that <br />the proposed use is consistent with the intent of the AG-I Agricultural Zoning District. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the evidence <br />presented and the factors to be considered pursuant to subsection d. of section 11 of the Hall <br />County Zoning Resolution, the use of the aforesaid property for the erection, operation and <br />maintenance of a microwave telecommunications tower is found to be consistent with the intent <br />of the AG-l Agricultural Zoning District and that the application for conditional use is hereby <br />granted subject to the following conditions, limitations, and restriction: <br /> <br />1. The tower shall at all times be maintained in a state of structural integrity. All waste, rubbish <br />and debris, if any, must be completely cleared from the above described real estate as soon as <br />practical and said real estate must, at all times, be kept in a clean and neat condition. <br /> <br />2. No uses under this resolution shall result in an unreasonable hazard or nuisance to the <br />adjacent landowners or to the general public. <br /> <br />3. The tower shall be constructed for multiple antenna capability and the applicant shall allow <br />the co-location of additional antennas upon the tower. <br />
