The followina conditions shall be aoolicable to any aoolication for administrative aooroval and shall be a condition of anv administrative aooroval bv the Buildina Insoector. 1 ) In the case of a dish antenna. the diameter of the antenna shall not exceed six feet. 2) In the case of an antenna other than a dish antenna. the heiaht of the antenna shall not exceed beyond thirty (30) feet of the tower's existina heiaht. 3) Conformance with the reQuirements of this Article. 17) LandscaoinQ. All tracts of land on which towers, antenna suooort structures, telecommunications facilities and/or antennas are located shall be subiect to the landscaoina reQuirements of the County Zonina Resolution. 18) Maintenance, Reoair or Modification of Existina Towers. All towers constructed or under construction on October 1, 2001 may continue in existence as a nonconforminQ structure and may be maintained or reoaired without comolvina with any of the reQuirements of this Article. NonconforminQ structures or uses may not be enlaraed or the deQree of nonconformance increased without comolvinQ with this Article. includina aoolvina for and obtainina a Tower Develooment Permit. Anv modification or reconstruction of a tower constructed or under construction on October 1. 2001 shall reQuire comoliance with the reQuirements of this Article includina aoolvina for and obtainina a Tower Develooment Permit. Said aoolication shall describe and soecify all items which do not como Iv with this Article and may reQuest. subiect to aooroval bv the County Board of Suoervisors. an exemotion from comoliance as a condition of the Tower Develooment Permit. 19) Insoections. The Countv reserves the riaht to conduct an insoection of towers. antenna suooort structures, telecommunications facilities and antennas uoon reasonable notice to the tower owner or ooerator to determine comoliance with this Article and to orevent structural and eQuioment failures and accidents which may cause damaae. iniuries or nuisances to the oublic. Insoections may be made to determine comoliance with the Buildine Code and any other construction standards set forth in the County Zonina Resolution. federal and state law or aoolicable ANSI standards. 20) Maintenance. The towers, antenna suooort structures. telecommunications facilities and antennas shall at all times be keot and maintained in aood condition. order and reoair so that the same does not constitute a nuisance to or a danaer to the life or orooertv of any oerson or the oublic. 21) Abandonment. If any tower shall cease to be used for a oeriod of three hundred sixty-five (365) consecutive days, the Buildina Deoartment shall notify the tower owner that the site will be subiect to a determination bv the BuildinQ Deoartment Director that the site has been abandoned. Uoon issuance of a Notice to Show Cause bv the Buildina Deoartment Director. the tower owner shall have thirtv (30) days to show bva oreoonderance of the evidence that the tower has been in use or under reoair durina the oeriod of aooarent abandonment. In the event the tower owner fails to show that the tower has been in use or under reoair durina the relevant oeriod. the Buildina Insoector shall issue a final determination of abandonment of the site and the tower owner shall have seventy five (75) days thereafter to dismantle and move the tower. In the event the tower is not dismantled and removed. the tower shall be declared a oublic nuisance bv the Buildina Insoector. or hislher desiQnee and a written reQuest shall be directed to Resolution Amending County Zoning Resolution P::tP'P. 10
