<br />ATTACHMENT "A" <br /> <br />1A~1551 <br /> <br />h) Person Anv natural person. firm. partnership. association. corporation. company. or other leaal <br />entity. private or public. whether for profit or not for profit. <br />I) Satellite Dish Antenna means an antenna consistina of a radiation element intended for <br />transmittina or receivina television. radio. microwave. or radiation sianals and supported by a <br />structure with or without a reflective component to the radiatina dish. usuallv circular in shape. <br />D Stealth means any telecommunications facility. tower. or antenna which is desianed to enhance <br />compatibility with adiacent land uses. includina. but not limited to. architecturally screened roof- <br />mounted antennas. antennas intearated into architectural elements. and towers desianed to look <br />other than like a tower such as liaht poles. power poles and trees. <br />k) Telecommunications Facilities means any cables. wires. lines. waive auides. antennas. or any <br />other eauipment or facilities associated with the transmission or reception of communications <br />which a person seeks to locate or has installed upon or near a tower or antenna support <br />structure. However. telecommunications facilities shall not include: <br />Any Conformina Commercial Earth Station antenna two (2) meters in diameter or less which is <br />located on real estate zoned General Industrial. Liaht Industrial. <br />Any earth station antenna or satellite dish antenna of one (1) meter or less in diameter. <br />reaardless of the zonina applicable to the location of the antenna. <br />I) Tower means a self-supportina lattice. auyed. or monopole structure that supports <br />Telecommunications Facilities. The term Tower shall not include non-commercial amateur radio <br />operator's eauipment as licensed by the FCC or structure supportina an earth station antenna <br />servina residential premises or dwellina units exclusively. <br />m) Tower Development Permit means a conditional use permit issued by the County upon approval <br />by the County Board of Supervisors of an application to develop a tower within the zonina <br />iurisdiction of the County. which permit shall continue in full force and effect for the term of the <br />permit aranted. Upon issuance. a Tower Development Permit shall be deemed to run with the <br />land durina the permit's duration and may be transferred. conveyed and assianed by the <br />applicant to assians and successors-in-interest. <br />n) Tower Owner means any person with an ownership interest of any nature in a proposed or <br />existina tower followina the issuance of a Tower Development Permit. <br /> <br />3. All terms in this Article which are not specifically defined herein shall be construed in accordance <br />with the Communications Act of 1934. the Telecommunications Act of 1996 and the Rules and <br />Reaulations of the Federal Communications Commission (FCC). <br /> <br />4. Location of Towers and Construction Standards. <br />a) Towers shall be permitted conditional uses of land in only the followina zonina districts: AG1. <br />AG2. HC. RC. LC. LI. GI. AG-~C. AG-SE. AG-SI. Towers less than 100 feet shall be permitted <br />in the followina zonina districts: TA1. TA2. R1. R2. SRC. Towers areater than 100 feet shall not <br />be permitted in the followina zonina districts: TA1. TA2. R1. R2. SRC. Towers areater than 100 <br />feet shall be allowed in the PUD zonina district if specified in the approved development plan. <br /> <br />b) No person shall develop. construct. modify or operate a tower upon any tract of land within the <br />zonina iurisdiction of the County prior to approval of its application for a Tower Development <br />Permit by the County Board of Supervisors and issuance of the permit by the County. Applicants <br />shall submit their application for a Tower Development Permit to the Buildina Department in <br />triplicate and shall pav a filina fee in accordance with Section . Subsection 24. <br /> <br />c) All towers. telecommunications facilities and antennas on which construction is commenced <br />within the zonina iurisdiction of the County after October 1. 2001. shall conform to the County <br />Buildina Code and all other construction standards set forth in the County Zonina Resolution. <br />federal and state law. and applicable American National Standards Institute (ANSI) standards. <br />Upon completion of construction of a tower and prior to the commencement of use. an enaineer's <br />certification that the tower is structurally sound and in conformance with all of the <br />aforementioned applicable reaulatorv standards shall be filed with the Buildina Department. <br /> <br />Resolution Amending County Zoning Resolution <br />PRPP. 4 <br />
