The <br />Election Commissioner is hereby requested, authorized and directed to take all steps <br />necessary and appropriate in connection with said election, including designation of <br />polling places, appointment of the election officials and otherwise conducting the <br />election as provided by law. The County hereby agrees to reimburse said Election <br />Commissioner for the costs of said election, as provided by law. <br /> <br />Section 5. The form of ballot and form of notice for said bond election shall <br />be substantially in the form submitted to this meeting, copies of which forms shall <br />be made a part of the minutes of the meeting at which this resolution is adopted; <br /> <br />and <br /> <br />WHEREAS, on August 30, 2002 representatives of the Hall County Museum Board <br />appeared before the County Board of Supervisors of Hall County, Nebraska ("County Board") <br />and requested that County Board rescind the Resolution #02-0048 adopted on August 13,2002 <br />and any related Resolutions or actions which call for a public vote on November 5, 2002 on the <br />question of issuing bonds of $4,900,000.00 to fund an operating train at Stuhr Museum. <br /> <br />NOW BE IT RESOLVED as follows: <br /> <br />Section 1. Upon request of the Hall County Museum Board, the County Board hereby agrees to <br />the termination of the Joint Declaration ofIntent (the "Agreement") by and between the County <br />and the Hall County Museum Board setting forth the intentions and agreements ofthe County and <br />the Museum Board with respect to a joint recreational project relating to an operating train at the <br />Stuhr Museum and that the Agreement should be and hereby is terminated and the execution and <br />delivery of any documents required to effectuate the termination of said agreement is hereby <br />authorized and the Chairman of the County Board shall execute and deliver any such documents as <br />appropriate upon the advice of the County Attorney. <br /> <br />Section 2. Any previous action taken by the County Board relative to the placement, at the <br />statewide general election to be held on November 5, 2002, a proposition to issue its negotiable <br />bonds in the amount of not to exceed Four Million Nine Hundred Thousand Dollars ($4,900,000); <br />and to levy annually, and as long as any of said bonds are outstanding, a tax upon all of the taxable <br />property in said County sufficient in rate and amount to pay the interest on and principal of said <br />bonds as the same become due and payable should be and the same is hereby rescinded and shall be <br />considered null, void, and of no effect. <br /> <br />Section 3. The Hall County Clerk is hereby authorized and directed to certify a copy of this <br />resolution to said Hall County Election Commissioner. The Hall County Election Commissioner is <br />hereby directed to disregard Resolution #02-0048 and shall not place, at the statewide general <br />election to be held on November 5, 2002, a proposition relative to the issuance by Hall County of <br />its negotiable bonds in the amount of not to exceed Four Million Nine Hundred Thousand Dollars <br />($4,900,000); and to levy annually, and as long as any of said bonds are outstanding, a tax upon all <br />
