<br />r20020453 <br /> <br />RESOLUTION #02- DO ~ 8 <br /> <br />A RESOLUTION WITH RESPECT TO A JOINT RECREATIONAL PROJECT <br />RELATING TO AN OPERATING TRAIN AT STUHR MUSEM <br /> <br />BE IT RESOLVED by the Board of Supervisors of The County of Hall, in the State of <br /> <br />Nebraska, as follows: <br /> <br />Section 1. The Board of Supervisors of The County of Hall, in the State of <br />N ebraska (the "County") hereby finds and detennines that there has been presented <br />to the Board of Supervisors the fonn of a Joint Declaration of Intent (the <br />"Agreement") by and between the County and the Hall County Museum Board (the <br />"Museum Board") setting forth the intentions and agreements of the County and the <br />Museum Board with respect to a joint recreational project relating to an operating <br />train at the Stuhr Museum (the "Operating Train") and that the Agreement should be <br />and hereby is approved and its execution and delivery is hereby authorized and the <br />Supervisors shall execute and deliver the Agreement in substantially the from <br />presented but with any such changes as shall be deemed appropriate by them upon <br />the advice of the County Attorney. <br /> <br />Section 2. Pursuant to and in accordance with the tenns of the Agreement, <br />the County is in need of equipment, improvements to land (as owned by the <br />Museum Board) and other property suitable for use as a part of a joint recreational <br />facility (consisting of the Operating Train and related improvements and equipment) <br />and that to provide funds for acquiring, holding, improving and operating such <br />facility the County should issue its negotiable bonds in the amount of not to exceed <br />Four Million Nine Hundred Thousand Dollars ($4,900,000); and that in order to <br />provide for payments on such bonds and for related project costs it is necessary and <br />advisable to levy annually, and as long as any of said bonds are outstanding, a tax <br />upon all of the taxable property in said County sufficient in rate and amount to pay <br />the interest on and principal of said bonds as the same become due and payable <br />(which levy may cause the aggregate taxes of the County to exceed the limitation <br />provided by Article VIII, Section 5 of the Constitution of the State of Nebraska), <br />with the proposal for such bonds and for such levy to be presented as a single <br />question for the approval of the electors of the County; and that the question of the <br />issuing such bonds and providing for such levy should be submitted to the electors <br />of the County at the statewide general election to be held on November 5,2002. . <br /> <br />Section 3. At the statewide general election to be held on November 5, <br />2002, there shall be submitted to the qualified electors of this County the following <br />proposition: <br /> <br />"Shall The County of Hall, in the State of Nebraska, issue the <br />negotiable bonds of the County in the principal amount of not to <br />
