<br />r 20020088 <br /> <br />HALL COUNTY BOARD OF SUPERVISORS <br /> <br /> <br /> <br />2b DISCUSS AND APPROVE PLANS FOR BEL TZER BUILDING - County Attorney <br />Jerry Janulewicz stated that he has met with the architect and with the building and <br />grounds committee several times. They now have the specifications and he would like <br />to set a bid date. The architect is confident that the remodeling can be done for the <br />amount they have set. The elevator will be remodeled to meet ADA standards. Some of <br />the elevator equipment will be moved from below the elevator to an equipment room. <br />Jeffries made a motion and Hartman seconded to approve the plans and set the bid <br />opening date for March 12 at 9:30 a.m. Arnold, Eriksen, Hartman, Humiston, Jeffries, <br />Lancaster and Logan all voted yes and none voted no. Motion carried. <br /> <br />2c DISCUSSION ON VACATION OF CAAP ROAD RIGHT-OF-WAY IN TRACTS 23a <br />AND 23b NORTH OF THE MAGAZINE AREA AND 48C & D ON THE SOUTH <br />MAGAZINE AREA - 2c County Attorney Jerry Janulewicz provided the board members <br />with a letter regarding the vacation of the roads in the tracts at CAAP. The roads are <br />section line roads but these were vacated in 1940 and have not been re-opened. The <br />tracts were purchased and the owner is requesting to place gates at the ends of the <br />road. Janulewicz recommended that a license be formed addressing this. He listed the <br />following requirements: <br /> <br />1. Be approved by the Corps of Engineers on behalf of the Army; <br />2. Become effective upon the recording of the purchaser's deed from the Department of <br />the Army; <br />3. Contain a clause reserving to the County the right to terminate the license at any <br />time, with or without cause; <br />4. Provide that up termination of the license the licensee shall remove the gate from the <br />easement within 10 days following termination; <br />5. Reserve to the County all rights granted to it by the Department of the Army as <br />expressed in the easements recorded in the office of the Hall County Register of <br />Deeds as document #200003926 and 200101488 <br />6. Reserve to the County the Right to enter upon said easements and rights-of-way at <br />any time with or without notice to the licensee; <br />7. Provide that the Licensee shall be responsible for the costs of erecting and <br />maintaining the gates and shall ami8ntain the same in good condition; <br />8. Provide that the Licensee shall erect and maintain in good condition all necessary <br />traffic warning signs, as directed by the County Public Works Director, at the <br />approaches to the gates; <br />9. Provide that the licensee may place locks on such gates provided that it provide keys <br />to such locks, with: the County Public Works Department, the appropriate Fire <br />Protection District; the County Clerk; the Department of the Army; and any public <br />utility have electric, gas, telephone, or other utility facilities upon or under said right- <br />of-way <br /> <br />4 <br />
