The above-described actions and designations shall <br />be subject to all covenants, conditions, restrictions, and limitations contained in the Board's prior <br />resolutions designating DTE as transferee and any agreements by and between DTE and the <br />County of Hall pertaining to DTE's designation as transferee. <br /> <br />3. Survey And Changes In Descriptions And Parcels. The above descriptions of easements and <br />parcels are approximate and intended only to describe the general area to be conveyed to DTE or <br />to be withdrawn ftom prior designation. DTE shall be required to furnish revised surveys of the <br />subject easements and parcels to the Committee and the Board by 21 June 2003. The Board and <br />the Committee may require changes to any parcel description, boundary, or dimensions as <br />necessary to accommodate the needs of the County of Hall or the Committee. <br /> <br />4. Abandonment of Designation. The Board may rescind and cancel this designation in whole or in <br />part if the designation is abandoned by DTE or is not concluded within 24 months foIlowing a <br />determination by the Department of the Army that said property is eligible and available for <br />transfer or sale. <br /> <br />5. Designation of Nebraska Public Power District. That NPPD be designated by the Board as <br />transferee of the following described lands, tracts, and interests, to wit: <br /> <br />5.1. Fee title to U.S. Government Tracts numbers 24,34,35,36, and 47 excluding existing <br />rail facilities located thereon and subject to an easement for rail purposes upon the lands <br />upon which the same are located. <br /> <br />6. Abandonment of Designation.
