<br />-r03314 <br /> <br />COUNTY ATTORNEY DISCUSS AND TAKE ACTION ON PROPOSED RESOLUTION <br />WITHDRAWI~G DESIGNATION OF DTE RAIL SERVICES INC. - County Attorney <br />Jerry Janulewlcz was present, also present were Gary Hedman With SPPD and Ken <br />Hinman with DTE Rail. He stated that this matter came forward from the Reuse <br />Committee meeting concerning the request to withdraw the designation of tracts 24, 34, <br />35, 36 and 47, except for the existing rail facilities and the easements for the rail <br />purposes. The reuse committee approved this request and a resolution and a letter has <br />been prepared for this change and distributed to the county board. <br /> <br />Eriksen made a motion and Jeffries seconded to approve Resolution #03-0034 <br />withdrawing designation of DTE Rail Services, Inc. as transferee of certain lands and <br />interest at CAAP and designating Nebraska Public Power District as the transferee of <br />the same. Arnold, Eriksen, Hartman, Humiston, Jeffries, Lancaster and Rye all voted <br />yes and none voted no. Motion carried. <br /> <br />RESOLUTION #2003-.(tl2r4 <br />A RESOLUTION WITHDRAWING DESIGNATION OF DTE RAIL SERVICES, INC. <br />AS TRANSFEREE OF CERTAIN LANDS AND INTERESTS AT CAAP AND <br />DESIGNATING NEBRASKA PUBLIC POWER DISTRICT AS TRANSFEREE OF THE <br />SAME <br /> <br />WHEREAS, DTE Rail Services, me., hereinafter "DTE," was designated by the County <br />Board of Supervisors ofRall County, Nebraska, hereinafter the "Board," as the transferee of <br />certain lands, tracts, and interests at the Cornhusker Anny Ammunition Plant, hereinafter <br />"CAAP, and <br /> <br />WHEREAS, the aforesaid designation authorized the United States Department of Anny to <br />sell certain lands, tracts, and interests to DTE at fair market value, and <br /> <br />WHEREAS, DTE subsequently provided to the Comhusker Anny Ammunition Plant Reuse <br />Committee, hereinafter the "Committee," and the Board its request that DTE's designation as the <br />transferee of a portion of the lands, tracts, and interests previously designated be withdrawn as <br />set forth herein, and <br /> <br />WHEREAS, on April 30, 2003 the Committee approved the withdrawal DTE's designation as <br />transferee of the below described lands and interests and approved designation of Nebraska <br />Public Power District, hereinafter "NPPD," as transferee of the same. <br /> <br />BE IT RESOLVED as follows, to wit: <br /> <br />1. That the Board's designation ofDTE as transferee of the following described lands, tracts, and <br />interests be withdrawn and of no effect, to wit: <br /> <br />1.1. Any and all interests in and to real and or personal property located within the boundary <br />fences of bomb load lines 1 thorough 4, inclusive; <br /> <br />1.2. Any and all interests in and to U.S. Government Tracts numbers 24,34,35,36, and 47 <br />except reserving to DTE a designation as transferee of existing rail facilities located thereon <br />and an easement for rail purposes upon the lands upon which the same are located; <br />
