<br />to3295 <br /> <br />~ <br /> <br />Resolution #03-031 <br /> <br />A RESOLUTION ASSIGNING DUTIES FOR ABANDONED MOTOR VEHICLES; <br />AUTHORIZING DISPOSITIONS AND SALES OF ABANDONED MOTOR VEHICLES; <br />AND ESTABLISHING STORAGE FEES. <br /> <br />WHEREAS, Nebraska Revised Statutes 99 60-1901, et seq., provides that local <br />authorities such as cities, villages, and counties are responsible for the removal and <br />disposition of motor vehicles that are abandoned on public or private property within the <br />jurisdiction of the local authority; and <br /> <br />WHEREAS, title to an abandoned vehicle vests in the local authority when the <br />vehicle has a value of less than $250.00, when the last registered owner cannot be <br />ascertained, or when the last registered owner fails to claim the vehicle within five days <br />from mailing notice that said vehicle has been recovered. Except for vehicles having a <br />value of less than $250.00, vehicles for which title vests in the local authority must be <br />sold by the local authority and the proceed thereof, less expenses, must be held by the <br />local authority for the benefit of the owner; and <br /> <br />WHEREAS, the local authority is permitted to recover the expenses incurred by <br />the local authority, including the costs of removal and storage. <br /> <br />NOW BE IT RESOLVED as follows: <br /> <br />1. The Hall County Sheriff is assigned responsibility of performing the obligations of <br />the County of Hall with respect to abandoned motor vehicles, including the <br />removal, notification of owners and lienholders, and disposition of motor vehicles <br />abandoned within the unincorporated areas of the County of Hall. <br />2. Any proceeds from the sale of an abandoned vehicle less expenses incurred by <br />the sheriff's department shall be held by the County Treasurer, without interest, <br />for the benefit of the owner of such vehicle for a period of two years. If not <br />claimed within two years, said proceeds shall be paid into the general fund of the <br />County. <br />3. The last registered owner of an abandoned vehicle shall be liable for the costs of <br />any expenses incurred with respect to said vehicle, including, but not limited to, <br />the cost of removing and storing the vehicle, providing notice to the owner and <br />lienholders, and advertising and conducting a sale of the vehicle. <br />4.
