<br />F03223 <br /> <br />RESOLUTION #03- 0 Q;1. ~ <br /> <br />A RESOLUTION APPROVING DESIGNATION OF HALL COUNTY AS A HYBRID <br />ENTITY FOR PURPOSES OF HIP AA COMPLIANCE <br /> <br />WHEREAS, pursuant to Neb.Rev.Stat. 923-104(6) (Reissue 1997), Hall County has the <br />power to do all acts in relation to the concerns of the County necessary to the exercise of its <br />corporate powers; and, <br />WHEREAS, pursuant to Neb.Rev.Stat. 923-103 (Reissue 1997), the powers of a County <br />as a body are exercised by the County Board; and, <br />WHEREAS, Congress enacted the Health Insurance Portability and Accountability Act of <br />1996 ("HIP AA"), governing the protection of and release of Protected Health Infonnation ("PHI"); <br />and, <br /> <br />~._----~--~_. <br /> <br />--~-- <br /> <br />WHEREAS, entities such as Hall County are impacted by HIP AA because of the Health <br />Plan and Health Care aspects of county government which contain PHI; and, <br />WHEREAS, Hall County has already established a HIP AA Compliance Initiative, <br />appointed a HIP AA Coordinator, and appointed and recognized a HIP AA Steering Committee, so <br />that Hall County will meet the federal mandates imposed by HIP AA; and, <br />WHEREAS, Hall County contains a number of departments, divisions, or programs, or <br />offices housed within the buildings maintained and administrated by Hall County, which handle <br />individually identifiable health infonnation ("IIHA"), and must comply with HIP AA requirements; <br />however, Hall County contains a number of departments, divisions, or programs, or offices housed <br />within the buildings maintained by Hall County, which fall outside of the scope of HIP AA because <br />they do not handle IIHI, or because they have only minimal and incidental contact with IIHI; and, <br />WHEREAS, to develop and further implement a HIP AA Compliance Plan, Hall County <br />must designate in writing which County functions are within HIP AA's scope and which are not; <br />and, <br /> <br />WHEREAS, Hall County has determined that it should be designated as a "hybrid covered <br />entity" for purposes of HIP AA implementation; and, <br />WHEREAS, Hall County, through its HIP AA Coordinator, has developed a list setting <br />forth those county departments, divisions, or programs, or offices housed within the buildings <br />maintained and administrated by Hall County, which would be considered "health care components" <br />
