<br />'" <br /> <br />F03213 <br /> <br />r' .. ~ <br /> <br />NOW THEREFORE, pursuant to the powers granted under the Zoning Resolution as <br />adopted by the Board of Supervisors of Hall County, Nebraska, the Hall County Board of <br />Supervisors, hereby grants to Platte River By-Products, Ltd. a Conditional Use Permit to use the <br />above described real estate for the purpose of operating an animal rendering plant, SUBJECT to <br />the following conditions, restrictions and limitations: <br />1. The above-described said real estate must, at all times, be kept in a clean, neat and <br />orderly condition. <br />2. No carcasses of dead animals, offals, spoiled meats, or putrid animal substances shall be <br />placed or stored upon the real estate in such a way as to create an unreasonable hazard or <br />nuisance to adjacent landowners or to the general public. <br />3. No uses under the Conditional Use Permit shall result in air, water, or groundwater <br />pollution that creates an unreasonable hazard or nuisance to the adjacent landowners or <br />to the general public. <br />4. The term of the Conditional Use Permit shall be for a period of five (5) years beginning <br />the date hereof, but may be terminated if permittee fails to comply with any of the <br />conditions, restrictions and obligations set forth herein. The Hall County Board of <br />Supervisors shall notify the permittee in writing setting forth the specific area of <br />noncompliance. If the permittee fails to take reasonable action to comply with the <br />notice of noncompliance and correct any or all violations within 30 days after receiving <br />said notice, the Hall County Board of Supervisors shall hold a hearing to consider the <br />revocation and termination of the Conditional Use Permit by a majority vote. <br />5. Nothing in this grant of Conditional Use shall be construed as a grant of right, authority <br />of Permit to allow any use of land, materials or methods which violate any state or <br />F ederallaw or rule or regulation of federal, state or local agency other than as <br />specifically set forth herein. The permittee shall comply with all applicable local, <br />state, and federal laws and regulations including, but not limited to, those pertaining to <br />water quality, flood control and protection, and environmental quality and protection, <br />6. The rights granted by this permit of conditional use shall not be assignable or <br />transferable and shall not run with the land, <br />This Conditional Use Permit is hereby granted this 8th day of April 2003 subject to the <br />terms, conditions and restrictions above set forth. <br />
