determination that the proposed use is consistent with the intent of the AG-SI Special Agriculture/Industrial Zoning District; and NOW THEREFORE BE IT RESOLVED that, upon consideration of the evidence presented and the factors to be considered pursuant to Subsection d. of Section 11 of the Zoning Resolution, the use of the aforesaid property for the operation and maintenance of a construction and demolition waste disposal area, as conditioned hereby, is found to be consistent with the intent of the AG-SI Special Agriculture/Industrial Zoning District and that the application Conditional Use is hereby granted subject to the following conditions, limitations and restrictions: 1. The aforesaid construction and demolition waste disposal area shall be operated and maintained in conformance with the following: a. Applicant's site plan and construction plans attached hereto and dated December 11, 2025; and b. Applicable permits issued to Applicant by the Nebraska Department of Environmental Quality. 2. The Property must, at all times, be kept in a neat condition. 3. The Applicant shall comply with all applicable County, State and Federal Laws and Regulations including, but not limited to, those pertaining to building and construction codes and standards, surface water and ground water quality, surface water drainage and flood control and protection, and environmental quality and protection. Nothing in the grant of this Conditional Use shall be construed as a grant of right, authority or permit to allow any use of the land, materials, actions or materials which violate and State or Federal Law or Rule or Regulation of a Federal, State or Local Agency other than as is specifically set forth herein. 4. Upon request by the County, Applicant shall permit access to the Property by the County Zoning Administrator and/or other designated County Agents and/or Representatives for the purpose of inspecting said property and determining compliance with this resolution. 5. Applicant shall supply to the County Zoning Administrator a copy of any notices or correspondence received by Applicant from the Nebraska Department of Environmental Quality relating to the construction, operation, maintenance, alteration or discontinuance of said construction and demolition waste disposal area, including, but not limited to, any notice of actual or possible violation of State Laws or Regulations. Said copies shall be provided within ten (10) days of receipt by Applicant. 6. The term of this Conditional Use Permit shall be for a period of TEN (10)years but may be terminated if Applicant fails to comply with any of the conditions set forth herein.
