Quandt asked when we have a tort claim that comes to Hall County, we refer that to <br /> NIRMA. Correct. <br /> Klein stated you do, but I provided enough information that tells the board that my <br /> guidance to this board is going to be to deny Wood River's claim, the County's is taking <br /> additional actions to look into what can and cannot be done. Wood River would then if <br /> we deny that claim they have to decide what it wants to do next. <br /> I do not believe the board has the authority to shift that burden instead of denying the <br /> claim to take that claim and put it into somebody else's lap. <br /> I don't believe the board has that authority. So, that's all I'm saying, I just don't think we <br /> have the authority to do that, and I'd like some continued time to work through this <br /> issue. <br /> Richardson asked Quandt if he was going to withdraw his motion <br /> Quandt said no <br /> Richardson stated, "I don't know why we would make a motion that would go against <br /> the advice of our county attorney personally, but let's go ahead and vote, please. <br /> Motion on floor Quandt made seconded by Bredthauer was to refer the claim of <br /> $78,947.67 to the County Assessor Kristi Wold's bond. <br /> Hurst, Lancaster, Peterson, Richardson, Sorensen all voted no, Quandt and Bredthauer <br /> voted yes, 5 no votes, 2 yes votes, motion failed. <br /> Klein stated I want to be clear. I'm the county attorney not for this board only, but I am <br /> the county attorney for Wood River and all our various communities here as well. And I <br /> am not trying to shirk any responsibility the county has with respect to Wood River. I just <br /> I think we've got to do things when we find the legal answer, and this is this is by all <br /> accounts for me, for the individual referenced at NIRMA, and for the State of Nebraska's <br /> Department of Revenue , a unique situation that I want to get a solid answer for in order <br /> to serve the citizens of Hall County, including Wood River as well. <br /> Richardson made a motion to deny the claim from Wood River for additional tax due in <br /> amount of$78,947.67. Sorensen seconded the motion. <br /> Hurst, Quandt, Lancaster, Peterson, Richardson and Sorensen all voted yes, <br /> Bredthauer voted no. 6 yes votes, 1 no, vote, motion carried. <br /> Meeting adjourned 10:35 a.m. <br /> Oeltitft <br /> o � <br /> y 1 <br /> hands Conley, Deput oun y Cler w 1 <br /> RA .- <br />
