Quandt agreed that he had seen something on the news about that as well.
Quandt withdrew his motion for clarification and Lancaster withdrew her second.
Verplank is going to do some checking and bring the exemption back in couple weeks.
Meeting was paused at 9:08 a.m. to go back into regular board meeting
5. CLOSED SESSION REGARDING GREAT PLAINS WOOD RIVER TERC
LITIGATION-Held closed session from 9:34 a.m. to 9:56 a.m.
6. DISCUSSION & POSSIBLE ACTION REGARDING CLOSED SESSION
REGARDING GREAT PLAIN WOOD RIVER TERC LITIGATION-No votes or action was
taken regarding this item.
7. CLOSED SESSION REGARDING ADDITIONAL TAX DUE TO THE CITY OF WOOD
RIVER FOR ANNEXED PROPERTY IN THE AMOUNT OF $78,947.67-Held closed
session 9:56 a.m. to 10:07 a.m.
8. DISCUSSION & POSSIBLE ACTION CLOSED SESSION REGARDING
ADDITIONAL TAX DUE TO THE CITY OF WOOD RIVER FOR ANNEXED PROPERTY
IN THE AMOUNT OF $78,947.67-Quandt made a motion to refer the claim of
$78,947.67 to the County Assessor Kristi Wold's bond, Bredthauer seconded the
motion.
County Attorney Marty Klein stated he did not believe they had the legal authority to
make that motion, he suggested the board not consider that motion. Klein stated he can
not tell them if they have the legal authority to do that, but he suspects they do not. He
suggests the board does not consider that motion or vote against that motion.
Lancaster stated the entity affected by the loss of
revenue that could do such a thing? Is that what you're saying? Basically, in other
words, the city of Wood River she asked
Klein stated, I think the city of Wood River is the only entity that could try to attach to
that bond or recoup from that bond. I do not believe the County has the authority to shift
that claim which has been for roughly $78,000, I do not believe that we can the Hall
County Board has the authority to move that claim from Hall County generally to
the assessor's bond. I think that that is a claim that has to be made by Wood River
against that bond if that's what they choose to do in response to the
fact that the board is contemplating other motions with respect to that claim. I know the
motion has been made and it's been seconded. So, you're discussing it now, but I would
encourage the board to vote against this motion because I do not believe the county
board has the authority to pass this motion particular motion or have the motion
withdrawn.
