9:05 a.m. Held a Board of Equalization meeting <br /> 9:09 a.m. Adjourned the Board of Equalization meeting and returned to the regular <br /> meeting. <br /> 5. DISCUSS & TAKE ACTION REGARDING THE GATE & CULVERT AT AMICK <br /> ACRES - John Amick from Doniphan was present. He stated the Doniphan School <br /> board met last night and they did not approve to help pay for the culvert. John provided <br /> the board with additional information from the Bald & Golden Eagle Protection Act and <br /> read parts from the act. The eagles come and go at this time of year but the real test <br /> will be in January when if they come back. This may also interfere with the crane <br /> viewing in April. He expressed concern on the beeping noise and the lights this may <br /> interfere with the nesting site. John said he would be willing to pay for both of the <br /> culverts and noted the quote he had from Ace Eaton. He suggested another site for the <br /> culverts they do need a turnaround but put it in a better place. He feels this is the <br /> prudent thing to do and is asking for the board's consideration. He said that Jim <br /> Castleberry also talked to Amanda and Jim he said he also talked to Jeremy Tenkley <br /> with enforcement. Federal agencies are not proactive but may will come down on <br /> issues. <br /> Sorensen also noted information from the act that "eagles are unlikely to be disturbed <br /> by the use of roads". <br /> Sorensen made a motion and Hurst seconded to leave the gates where they currently <br /> are. <br /> Jim Castleberry recommended to contact Jeremy Tenkley with enforcement. This <br /> would be a civil matter. <br /> Sorensen said the decision was made and if necessary the option could be rescind his <br /> motion stands. Scott said he will contact Jeremy Tenkley his number is 402 727 4413. <br /> Lancaster said she does not know about the eagles but the school is the biggest factor <br /> the turnaround is important. She said she talked to Gregg Robb from Doniphan <br /> regarding the concerns. She gave Gregg Don Robb's number and did not know the <br /> gate had been moved. She said there needs to be some common ground. <br /> The vote on the motion to leave the gates was taken. Bredthauer, Hurst, Quandt, <br /> Peterson and Sorensen all voted yes and Lancaster voted no. Richardson was absent. <br /> Motion carried. <br /> Sorensen said he will call Jeremy Tenkley. Scott and Gary expressed concern on the <br /> lack of communication on this issue. <br /> 2 <br />
